my brother got married in 2004 .his wife file a maintenance case in family court indore .Court ordered my brother to pay maintenance on his central govt job status.

he paid 12000/ rs after that he lost his job as he is fighting corruption inthe dept and other reasons that her wife send summons at his office address.

Now again in 2010 she again file new maintenance and divorce case. she is working as ateacher i have aproof . she claim in her petion in family court that she is housewife.

Now court ordered my brother to pay 22000 otherwise the arrest will happen.

what he should do.

He can file application under 127 as his jobless.

can he file perjury in the same court.

or he can move to highcourt to stay on his arrest as condition of status changes after he lost his job. Court staff is with her.

FILE AN APPLN. OF PERJURY IN THE SAME COURT WHERE SHE STATED SHE I HOUSE WIFE IN AN AFFIDAVIT ON OATH. SUBMIT HER WORKING DETAILS COPIES.

THAT WOULD BRING HER DOWN OF HARSH ATTITUDE OF BEING ARRESTING YOUR WIFE AND ADVERSE INFERENCE WOULD BE DRAWN AGAINST HER.

You can file the perjury in her HMA 24 application and also in your CrPC 127, you can mention that she was already working when the 125 order was given, which was hidden from the court. Moreover, if the file for 125(3) you need to file the counter regarding the maintenance as stated in the other post. The court will also give the chances for you to speak and give the chance for you to pay up. If not, then let the girl show that she is in disstress.
