Hello experts,

What is the way to approach lok adalat ? with below conditions.

a) No case is in court of law.

b) There was a complaint in CAW Cell, which has now been temperorily closed. and it's been 2-3 months nearly.

Lemme know if any other details are required please.

What is your motive to approach Lok Adalat? Want to stay with your wife or divorce? Please clarify.

Mahi,

You cannot approach Lok Adalat without any reason. If you are seeking mutual divorce, then you can go to Lok Adalat and get the same.

Further to what Hardik has advised, if you want to stay with your wife then you can file RCR and ask the court to transfer it to the Lok Adalat for reconciliation.

Dear Sir,

You can only approach to Lok Adalat once you have a case pending before the Court of Law. Lok Adalat is made for the settlement of disputes pending before the court.

However, you may approach the mediation center of the court by making a joint application for the settlement of disputes.

Hi,

Can I approach Lokadalat for my case pending in Chennai Family Court? I have sought divorce and I have recieved a counter. I wish to seek an eearly remedy to this situation and please advice me on this?

You can definately put the request to go to Lok Adalat. I would suggest you to ask for meidtation on the next date to get the issue sorted out early.

Chedda,

Lok adalat is generally for civil cases and not the criminal cases. If there is any civil case against you (like RCR, divorce or maintenacne) then this can be refered to Lok adalat.

Hello Hardik,

Thanks, but tell me what would be the impact? Say, if Lok adalat determines that there nothing much that it would be able to do, will it pass any sort of recommendation or its inputs on this case?Do Family court judges allow such a reference?

Dash,

Lok Adalat judges tries to settle the issues amicably e.g. if one of the spouse has filed RCR and another is not ready to live with him / her then Lok Adalat tries to settle their disputes otherwise they try that both the paties end their fight with MCD.

If nothing comes out fruitful (i.e neither staying together nor taking divorce),  the Lok Adalat judge writes his / her own recommendations on the petition like 'case is not fit for settlement' or 'respondent is absent' etc etc. The case is then sent back to the main court where this recommendation is also considered alongwith the normal proceedings of the case.

HELPFUL HARDIK SIR i want to know whether a case with the expartie order.which is now in the mmc is forward to the LOK ADALAT been stayed in the high court will give the relief to my sister as she cheated by her hubby by not settling the one time compensation.what is the next step to take by her. u r the right man to advice her clearly in this matter. pls help her .urgent case pls sir.
