Me and my second cousin want to get married, we would like to know the legality of this marriage and under which acts we can get married and the consequences of this marriage under law?. 2.Provided i have read the supreme court verdict about live in relationship will be presumed as marriage after certain time. How well that be applicable in our situation if we just stay in a live in together? He is my mother's mother's brothers son. Both are hindu Please reply asap, in urgent need of help. Thank you

If you fall under either prohibited class of relationship or sapinda relationship according to the Hindu marriage act, there will be no presumption of marriage even if you live together. Also medically speaking, marriage within prohibited relationship or sapinda relationship will turn on recessive fatal genes in the next generation which would result in lots of congenital birth defects in the child. This is the real reason behind such prohibition.

As your relationship with your cousin is prohibited by the Hindu MArriage Act as well as Special Marriage Act, you cannot marry him but if your custom allows then you can marry him and can escape from the Law of Prohibitory Relation.

Now,it is up to you what you wish to do. You can continue to relationship with your cousin at your own decision but in the eye of law marriage will not be acceptable even you continue live in relationship. In future, if  a child is born out of prohibitory relationship, on that occasion, the child may not be accepted as legitimate child rather illegitimate as your marriage is invalid in the eye of law.
