Title: Can a foreigner apply for a patent in India?

The Patents Act, 1970 does not put any limitation, or restriction on a foreigner in the matter of applying for or obtaining patents in India. However, when any country does not accord to the citizen of India, the same rights with respect to the grant of patents and protection of patents rights as it accord to its own nationals, no national of such country shall be entitled to any privilege under the Patents Act. The Government on 28th September 1998 notified 130 countries to be convention courtries thus nationals of these notified 130 countries are entitled to get a patent in India for their inventions.

Yes a foreigner can register his invention in India under the patent act
