Title: dv to get divorce?

If a victim of dv don't want to continue any longer the relation, is it necessary to file dv case or can she directly file divorce?
Will simply filing dv case help the wife to get divorce or not?

dv and divorce are seperate cases and filing a dv wont help to get divorce by any means

she can file a petition for contested divorce directly in the family court

OK but sir as we heard contested divorce is very critical and tough procedure for girls to win specially when the opposite party wants you to keep the wife hanging?

thats true.contested divorce can go through for years.only mcd can help you to get divorce easily.try to convince your husband on that

Hi
DV and divorce are two separate cases.

Domestic violence is a criminal case and the case is between the state government and accused. the victim is the complainant here. So the accused gets convicted and jailed. but that does not result in divorce.

A divorce proceeding should be initiated separately for judicial separation.

Dear Sir,

IF she a victim of domestic violence and looking for divorce, then she can directly file for divorce and also file an application under section 24 of HMA seeking maintenance in the said divorce petition. Filing a DV petition is not a requirement for filing for divorce as both are two different cases.
