Title: YouTube issues after 9 years
Post by: mottechy on March 13, 2017, 11:49:41 AM
Hallo,
I have uploaded a malayalam (indian language) devotional album in 2011, which was released in 2008.
I had around 20000 cilcks. (But i never profited from the file. It was a released on non-profit license)
Now the producer of the messaged me that he will file a case against me. Otherwise I have to pay him 2 Lakhs Indian Rupees. (He wrote me, his production cost in  2008 was 2 lakhs. But he wanted to sell the master now for 3.5 Lakhs to some one. )
Of course I deleted the file as his objection reached me.
Now he is telling, he wants compensation.
What should I do in this case?
Can he win the case after 9 years?

The question is not about you profiting.

But you became a barrier to this profit.

Once a video is added to YouTube it is also downloadable.

So you introduced his video to 20k listeners and download options to them.

Which in itself let to an assuming 40k added listeners.

So he could have earned from roughly 60k people.

Now let him file in court if he does than refer it to mediation and settle the amount

But it is an album released in 2008. I uploaded a medium quality (64kb) audio after 3 years.

Copyright validity of a sound recording or video recording is 60 years.
So he has a case.
