Title: Delayed implementation of Judgement from National Commission

Hi,

I have an ongoing case (Execution Appeal) in Hyderabad in the State of Telangana at the State Commission. I purchased a flat with a builder and he did neither start the work nor refund money collected. I approached the State Commission and the Judgement was to pay me the money with 12% interest and compensation from date of compliant. The builder went to National Commission and the National Commissions gave a judgement revising the compensation & interest to 15% and the same needs to be paid from the date of late payment from me immediately. This judgement from National Commission was given over two years back. As there was no Judge appointed at State Commission of Talangana after the state being formed I had to wait. Now that the judge is appointed, I have gone for execution appeal. The  builder is not paying as per judgement and the Judge at State Commission is lenient. After two years of judgement the builder has hardly deposited 10% of the consideration. Like this he may not repay me for rest of my life.

If you doing your own case personally then there must be lack of knowledge how to deal with execution case and how it has to be executed expediently. Or if you have appointed a lawyer then ask him to take appropriate steps.

Hi,

I have hired a lawyer at Hyderabad, Telangana. The response I get from my lawyer is we need to wait.

I wanted guidance what cam be done beyond waiting for two years after Judgement from National Commission for implementation of judgement.

The Judge has always been giving whatever time the builders lawyer requests without allowing my lawyer to speak. There are 13 execution appeals which come up same time and Judge simply gives next date immediately after all our cases come for hearing in execution appeal. This is happening in the last four instances already.

I want you kind guidance.  What should be done beyond Execution Appeal at State Commission.

Go to high court through a writ of mandamus.

Dear Sir,

1. You have to make a complaint to the National Commission/Supreme Court about the conduct of the judge in showing leniency towards builder.
