Title: Reopening a withdrawn case
Post by: rajivdutt on February 15, 2018, 04:43:57 AM
My lawyer has always told me that there is no benefit of perusing my case, my case is very weak and there is no hope.
I was not aware about my case, i trusted him too much.  He convinced me to withdraw my case.

But now, when i look back, the case was very strong and court had already issued Non-bailable Warrants to the other party.  So, i did a mistake and want to peruse again.

Can i reopen the case, if yes, what is the procedure?

Thanks,
Rajiv Dutt

Dear Sir,
Yes, you can re-open on the ground that your lawyer misdirected you to withdraw. But re-opening power lies with High Court. Please call me.

It may not be re-opened if you were there in the court when statement for withdrawn was made.
