a lawyer will help you achieve your goal thats his job, but decision has to be yours, a lawyer will not take decisions on your behalf.

show the judge a supreme court judgment that once a transfer application is filed in supreme court, the lower court should stay the matter till the decision is passed by the highest court.

that will be sufficient to get a stay.

In Mutual Divorce alimony is also mutually decided in advance before filing for mutual divorce, you both have to agree to the amount and mention the said amount in petition.

for mutual divorce one year separation is mandatory before filing for divorce (this your advocate will tell you how to manage it cannot advice you hear in open platform on this)

But you can file for divorce on grounds of cruelty, and since your wife is not coming for hearing, you may get an ex- parte divorce

What you are facing is what everyone faces in Court, law in reality does not work in India. thats the truth but we cannot discuss it, we cannot say it.

approaching supreme court is like lottery, and in your case you are holding the court responsible for delay, rarely judges go against judge.

the best and intelligent solution is you spend time negotiating with your wife over coffee, meet her regurarly and persuade her to get this over mutually.

In India we have courts and a justice system only for show. the sooner you understand this the better it is for your pocket and mental peace.
