Property laws / Re: preliminary decree - court - registration
« on: May 13, 2018, 09:47:33 PM »
Dear Sir,

Preliminary decree cannot be registered, you have to wait for the final decree for the registration. Final decree only decides the actual portion and which part of the property, which will fall in your share as per the partition decree.

Property laws / Re: Residential plot grabbing issue
« on: May 11, 2018, 02:16:46 AM »
Dear Sir,

As if now please file a criminal complaint for trespassing against the last landowner who sold the property. If nothing happens then file a civil suit for possession and injunction. Everything he is saying is Oral, and the same has no value in the eyes of law. Property is already transferred in the name of your father then mother (now), she is the absolute owner. This person won't be able to do anything except troubling you.

regards,

Dear Sir,

You have told your lawyer to take money to settle the matter. You know that you lawyer have taken money to settle the matter. It mean the same is done under your instructions as you wanted money to settle the matter. Now the lawyer is only not telling you that from whom he has taken money.

Further, you have also received the amount. Now you suspecting your lawyer that he must have cheated you by taking x amount and giving you y. If that was the case then you should have dealt with the other party directly and taken the amount directly.

Where is professional misconduct here.

Dear Sir,

Please file an application seeking directions against the police station SHO to file the charge sheet before the court as soon as possible. Once the application will be filed court will ask why there is a delay and this will expedite the process of filing the charge sheet.

If you cannot afford the lawyer then you may seek legal aid counsel.

« on: May 05, 2018, 04:09:19 AM »
Dear Sir,

Land was sold in 1965 and owner ship was transferred from him to the buyer. Only 3000 left to be paid. for which there is a limitation of 3 years to file a recovery suit. Which has already expired in the year 1968. This is the legal position.

Rest more can be said only after looking at the documents exchanged between the parties if something can be done.

the company must have filed the application under section 11 of the arbitration act for appointment of the arbitrator. Court will appoint the arbitration if there is arbitration clause in the agreement and claim will be referred to the arbitration tribunal for adjudication. What is exactly you are asking for here?

« on: May 05, 2018, 04:05:21 AM »
Dear Sir,

This is a civil transaction. You may file a suit for recovery against him  and seek refund of the money he has taken during the course of business from the people for business purposes. Once you file the case, then he has to prove that he has spent the money for company purpose or else return the same.
