Dear Sir,

If you are interested in purchase the property then issue legal notice for specific performance and then file a suit for specific performance for executing the sale deed in your favour. 5 marla or 9 marla is another issue. You are interested in the land which is in the name of the person, Kabza land is not the dispute.

If you do not wish to purchase the land then issue legal notice for non performance on the part of the contract on his part to execute the sale deed and ask for the return of the money. File a suit for recovery.

Try working out the marriage or else you may file for divorce on the grounds of mutual consent. If wife is not ready then you may also file for divorce on the grounds of cruelty. This is the only legal remedy to your problems.

If you only staying in the property then you can file on your own. Please file a suit for permanent injunction. You don't have to take NOC, just vakalatnama from everyone to file the suit, it can be filed by one person.

There is no such security, which can be asked if stay is granted by the high court in a suit for partition.

However, if there is no stay granted by the high court in the appeal filed, you may proceed to file the execution petition before the trail court. If execution is allowed and property is partitioned then the appeal may also become infractus in due course of time.

please file the appeal if stay is not granted.
