	<description><![CDATA[The word disgorgement means “to bring up and expel from the throat or stomach”, “to surrender (stolen goods or money or any other things) unwillingly”. In the financial markets, the word ‘disgorgement’ is used to mean the repayment of ill-gotten gains that is imposed on the wrong-doers by the courts or the regulators. Funds that were received through illegal or unethical business transactions, such as defrauding creditors or cheating investors, are disgorged, or paid back, with interest to those harmed by the illegal and/or unethical actions of the wrong-doers. Disgorgement is a remedial civil action rather than punitive civil action and disgorged money can be demanded from not only those entities/individuals directly involved in unethical and illegal business activities and those who violate securities regulations but also from anyone profiting from such activities. But it should be noted that the term disgorgement is not the same as imposing civil money penalties.... ]]></description>

	<description><![CDATA[Section 205 of the Act regulates the declaration and distribution of dividend. All the companies which have share capital other than section 25 companies and make profit are bound by law to declare and distribute dividends. As per Section 205 of the Companies Act, 1956, a dividend (including interim dividend) can be paid out of current profits or profits accumulated of earlier years. However, depreciation for the entire year has to be provided before a dividend is declared or paid. For this purpose, the Board needs to approve the provisional financial results (unaudited) and a working of the profits available for distribution as dividend, post providing for depreciation for the full year and amount required to be transferred to reserves as per the Companies.[1] Sections 205 A, B and C deal with some other aspects of distribution of dividend such as establishment of Investor Education and Protection Fund, Payment of unpaid and unclaimed dividend.... ]]></description>

	<description><![CDATA[Adultery is a ground for divorce under Section 13(1)(i) of Hindu Marriage Act, section 27(1)(a) of Special Marriage Act, Section 32 (d) of Parsi Marriage and Divorce Act,1936 and under Section 10 of the Indian Divorce Act .The ground for getting a decree for divorce on the grounds of adultery is provided as :“The Respondent has after solemnization of marriage, had voluntary sexual intercourse with any person other than his or her spouse.” In other words, the spouse who engages in extra-marital intercourse is guilty of adultery. Under the Dissolution of Muslim Marriages Act, adultery as such is not a ground for divorce, but if the husband “associates with women of evil repute or leads an infamous life,” it amounts to cruelty to wife and she can sue for divorce on that ground. This seems sometimes akin to living in adultery. But none of these enactments, except the Parsi Marriage and Divorce Act, confers any such corresponding right on the husband to dissolution of marriage... ]]></description>
