If such a rule did not exist, property could remain stagnant for generations \u2014 harming trade, commerce, and overall economic growth. The law ensures that property always remains in the hands of a living, competent owner who can use, manage, and transfer it as needed.<\/p>\n<p>The Rule against Perpetuity, therefore, is a rule against remoteness of vesting \u2014 it restricts how far in the future an interest in property can be created.<\/p>\n<h2 id=\"related-provisions\"><span class=\"ez-toc-section\" id=\"Related_Provisions\"><\/span>Related Provisions<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<table border=\"1\" cellspacing=\"0\" cellpadding=\"8\">\n<thead>\n<tr>\n<th>Section<\/th>\n<th>Description<\/th>\n<\/tr>\n<\/thead>\n<tbody>\n<tr>\n<td>Section 10<\/td>\n<td>Prohibits conditions that completely restrain alienation (transfer) of property.<\/td>\n<\/tr>\n<tr>\n<td>Section 13<\/td>\n<td>Governs transfers for the benefit of unborn persons.<\/td>\n<\/tr>\n<tr>\n<td>Section 20<\/td>\n<td>Deals with the vesting of interest in an unborn child once they are born.<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<h2 id=\"essentials-of-section-14\"><span class=\"ez-toc-section\" id=\"Essentials_of_Section_14\"><\/span>Essentials of Section 14<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>For the Rule against Perpetuity to apply, the following conditions must be met:<\/p>\n<ul>\n<li>There must be a transfer of property.<\/li>\n<li>The transfer must create an interest for an unborn person (the ultimate beneficiary).<\/li>\n<li>The unborn person must take the property as an absolute owner.<\/li>\n<li>The interest must vest (come into effect) before or at the death of the last living person with a prior interest.<\/li>\n<li>No interval should exist between the termination of the prior interest and the vesting of the ultimate interest.<\/li>\n<\/ul>\n<p>In other words, the transfer must not postpone ownership beyond the life of one or more living persons plus the period of minority of the unborn beneficiary.<\/p>\n<h2 id=\"transfer-to-unborn-child\"><span class=\"ez-toc-section\" id=\"Transfer_to_Unborn_Child_%E2%80%93_Sections_13_14\"><\/span>Transfer to Unborn Child \u2013 Sections 13 &amp; 14<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Normally, property can only be transferred between two living persons (<em>inter vivos<\/em>). However, Section 13 allows an exception \u2014 a transfer can be made for the benefit of an unborn child, provided:<\/p>\n<ul>\n<li>It is preceded by a life interest or limited interest in favor of a living person.<\/li>\n<li>The unborn child must come into existence before the death of that living person.<\/li>\n<li>The unborn child must take the property as absolute owner.<\/li>\n<li>If the unborn child dies before attaining maturity, the property reverts to the transferor or their legal heirs.<\/li>\n<\/ul>\n<h2 id=\"concept-of-gestation\"><span class=\"ez-toc-section\" id=\"Concept_of_Gestation\"><\/span>Concept of Gestation<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>A child <em>en ventre sa m\u00e8re<\/em> (in the mother\u2019s womb) is considered a competent beneficiary. The law recognizes the period of gestation as a valid postponement of vesting. Thus, if the prior life tenant dies while the ultimate beneficiary is still in the womb, the property vests in the unborn child once born alive \u2014 though the interest remains contingent until then.<\/p>\n<h2 id=\"void-transfers-and-case-law\"><span class=\"ez-toc-section\" id=\"Void_Transfers_and_Case_Law\"><\/span>Void Transfers and Case Law<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>If a transfer creates an interest that may vest remotely, beyond the period allowed under Section 14, it becomes void.<\/p>\n<p>In <strong>Ram Nivaran v. Nanku<\/strong>, the court held a transfer void where the vesting could be postponed for an excessively long period (e.g., 100\u2013200 years). The rationale was that such a condition would violate the rule by tying up property indefinitely.<\/p>\n<h2 id=\"exceptions\"><span class=\"ez-toc-section\" id=\"Exceptions\"><\/span>Exceptions<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Section 18 of the Act provides statutory exceptions to Section 14. Transfers made for the benefit of the public \u2014 such as for the advancement of religion, knowledge, commerce, or charity \u2014 are not subject to the Rule against Perpetuity.<\/p>\n<h2 id=\"comparison-with-english-law\"><span class=\"ez-toc-section\" id=\"Comparison_with_English_Law\"><\/span>Comparison with English Law<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>The Indian provision is largely influenced by English law, which allows postponement up to a life or lives in being plus 21 years. Similarly, Indian law permits postponement until the life of the last prior interest plus the minority of the unborn child, but not beyond.<\/p>\n<h2 id=\"conclusion\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>The Rule against Perpetuity under <strong>Section 14 of the Transfer of Property Act, 1882<\/strong> ensures that property does not remain tied up indefinitely and continues to serve social and economic functions. It balances the freedom of an owner to dispose of their property with society\u2019s interest in maintaining the free circulation of property.
