This Order regulates the <strong>production, pricing, quality, storage, and distribution<\/strong> of raw jute and jute textiles throughout India. It ensures fair trade, stable prices, and quality standards in the jute industry, which plays a vital role in India\u2019s packaging and export sectors.<\/p><div id=\"ez-toc-container\" class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>This order is officially titled the <strong>\u201cJute and Jute Textiles Control Order, 2016.\u201d<\/strong><br \/>\nIt extends to <strong>the whole of India<\/strong> and <strong>comes into effect<\/strong> on the date it is published in the <strong>Official Gazette<\/strong>.<\/p>\n<h2 id=\"rule-2\"><span class=\"ez-toc-section\" id=\"Rule_2_%E2%80%93_Definitions\"><\/span>Rule 2 \u2013 Definitions<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>To ensure clarity, the Order defines several key terms:<\/p>\n<ul>\n<li><strong>\u201cCarrier\u201d<\/strong> \u2013 includes anyone loading, unloading, or transporting raw jute or jute textiles by land, air, or water.<\/li>\n<li><strong>\u201cJute Commissioner\u201d<\/strong> \u2013 the Central Government\u2013appointed official responsible for implementing this Order. It includes the Deputy Jute Commissioner or any other officer appointed in this behalf to exercise the powers of the Jute Commissioner under this order.<\/li>\n<li><strong>\u201cJute mill\u201d<\/strong> \u2013 any manufacturer producing jute textiles from raw jute through mechanical or electrical processes.<\/li>\n<li><strong>\u201cJute textiles\u201d<\/strong> \u2013 yarn, twine, cloth, bags, sacks, sacking cloth, or other articles made wholly or partly from raw jute (if jute forms more than 50% of weight).<\/li>\n<li><strong>\u201cManufacturer\u201d<\/strong> \u2013 includes jute mills or any person producing jute textiles by any process.<\/li>\n<li><strong>\u201cRaw jute\u201d<\/strong> \u2013 the natural jute fibre, also known as pat, patsan, bimli, or mesta.<\/li>\n<li><strong>\u201cStockist\u201d<\/strong> \u2013 any person or agency holding stock of raw jute or jute textiles.<\/li>\n<li><strong>\u201cUnfair practices\u201d<\/strong> \u2013 include misappropriation, non-supply, short-supply, use of underweight, old, unbranded, or substandard jute bags etc.<\/li>\n<li><strong>\u201cYear\u201d<\/strong> \u2013 defined as the period from <strong>1st July to 30th June<\/strong> of the following year.<\/li>\n<\/ul>\n<h2 id=\"rule-3\"><span class=\"ez-toc-section\" id=\"Rule_3_%E2%80%93_Power_to_Fix_Prices\"><\/span>Rule 3 \u2013 Power to Fix Prices<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Under this rule, the <strong>Jute Commissioner<\/strong> may:<\/p>\n<ul>\n<li>Fix the <strong>minimum, maximum, or reasonable prices<\/strong> for raw jute and jute textiles through official notification in the <strong>Gazette of India<\/strong>.<\/li>\n<li>Base all prices on the <strong>Minimum Support Price (MSP)<\/strong> declared by the Central Government.<\/li>\n<li>Consider various factors such as <strong>freight, storage, handling costs<\/strong>, and quality while determining prices.<\/li>\n<li><strong>Ensure that no one purchases or sells raw jute above the reasonable price fixed under this rule.<\/strong><\/li>\n<li>Also, fix prices for jute textiles used under the <strong>Jute Packaging Materials (Compulsory Use in Packing Commodities) Act, 1987<\/strong>.<\/li>\n<\/ul>\n<h2 id=\"rule-4\"><span class=\"ez-toc-section\" id=\"Rule_4_%E2%80%93_Power_to_Control_Production\"><\/span>Rule 4 \u2013 Power to Control Production<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>The <strong>Jute Commissioner<\/strong> is authorized to:<\/p>\n<ul>\n<li>Direct any <strong>jute mill<\/strong> to produce specified <strong>quantities and grades<\/strong> of jute textiles.<\/li>\n<li>Ensure compliance with the <strong>Jute Packaging Materials (Compulsory Use in Packing Commodities) Act, 1987 (Act 10 of 1987)<\/strong>.<\/li>\n<li>Such directions are known as <strong>Production Control Orders (PCOs)<\/strong>.<\/li>\n<li>Also, direct <strong>importers, processors, and traders<\/strong> to mark, print, or brand jute textiles according to prescribed standards.<\/li>\n<\/ul>\n<h2 id=\"rule-5\"><span class=\"ez-toc-section\" id=\"Rule_5_%E2%80%93_Power_to_Regulate_Stocks_of_Raw_Jute\"><\/span>Rule 5 \u2013 Power to Regulate Stocks of Raw Jute<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>The Commissioner may:<\/p>\n<ul>\n<li>Specify the <strong>maximum quantity<\/strong> of raw jute or any variety that a manufacturer can purchase from any source during a specific period.<\/li>\n<li>Fix the <strong>maximum stock limit<\/strong> a manufacturer may hold at any time.<\/li>\n<\/ul>\n<p>In setting these limits, the Commissioner considers:<\/p>\n<ul>\n<li>The manufacturer\u2019s previous year\u2019s consumption.<\/li>\n<li>Stock levels in the preceding six months.<\/li>\n<li>Manufacturing capacity.<\/li>\n<li>Market stability and price control needs.<\/li>\n<li>Availability of raw jute for textile production.<\/li>\n<\/ul>\n<h2 id=\"rule-6\"><span class=\"ez-toc-section\" id=\"Rule_6_%E2%80%93_Ensuring_Easy_Availability_of_Raw_Jute\"><\/span>Rule 6 \u2013 Ensuring Easy Availability of Raw Jute<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>To make raw jute easily available and prevent hoarding:<\/p>\n<ul>\n<li>Stockists must <strong>register<\/strong> with the Jute Commissioner or authorized officers.<\/li>\n<li>They must not <strong>sell or deliver stock<\/strong> beyond specified limits without permission.<\/li>\n<li>They must <strong>maintain prescribed stock levels<\/strong><\/li>\n<\/ul>\n<p>The Commissioner takes into account the <strong>quantity, condition, grade, and genuine sale commitments<\/strong> before issuing such orders. This rule aims to prevent <strong>speculation and artificial scarcity<\/strong> in raw jute markets.<\/p>\n<h2 id=\"rule-7\"><span class=\"ez-toc-section\" id=\"Rule_7_%E2%80%93_Power_to_Inspect_Quality\"><\/span>Rule 7 \u2013 Power to Inspect Quality<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>The <strong>Jute Commissioner<\/strong> can:<\/p>\n<ul>\n<li>Require samples of jute textiles for inspection at specific times and places.<\/li>\n<li>Authorize officials from the Central or State Government, or accredited agencies, to draw samples for testing.<\/li>\n<li>Share the inspection report with the manufacturer, stockist, or carrier concerned.<br \/>\nThis ensures <strong>quality control<\/strong> and <strong>consumer protection<\/strong> in the jute industry.<\/li>\n<\/ul>\n<h2 id=\"rule-8\"><span class=\"ez-toc-section\" id=\"Rule_8_%E2%80%93_Power_to_Prohibit_Supply_by_Manufacturer\"><\/span>Rule 8 \u2013 Power to Prohibit Supply by Manufacturer<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>(a) The Jute Commissioner may prohibit a manufacturer from supplying jute textiles for 3 months to 2 years, depending on the seriousness of unfair practices, after conducting an enquiry.<\/p>\n<p>(b) The Commissioner can act suo motu or on a complaint from:<\/p>\n<ul>\n<li>An end-user, procurement agency, any person in jute trade, or the Director General of Supply and Disposal (DGS&amp;D).<\/li>\n<li>The complaint must relate to unfair practices in delivered or consigned jute textiles.<\/li>\n<\/ul>\n<p>Before passing such an order, the Commissioner must:<\/p>\n<ol>\n<li>Direct inspection by an officer (not below Inspector rank) with prior notice to the<\/li>\n<\/ol>\n<p>manufacturer.<\/p>\n<ol start=\"2\">\n<li>Provide the inspection report copy to the manufacturer.<\/li>\n<li>Issue a show-cause notice asking why action should not be taken.<\/li>\n<li>Allow a hearing and pass a reasoned order.<\/li>\n<\/ol>\n<p>(c) After passing the order, the Jute Commissioner has the right to dispose of the stock or consignment of jute textiles supplied by that manufacturer.<\/p>\n<p>(d) If a manufacturer fails to cooperate or obstructs inspection\/enquiry, he may also be banned from supplying jute textiles under procurement orders for 3 months to 2 years.<\/p>\n<p>(e) All such prohibition orders must be published in the Official Gazette.<\/p>\n<h2 id=\"rule-9\"><span class=\"ez-toc-section\" id=\"Rule_9_%E2%80%93_Power_to_Call_for_Information_Inspection_Search_and_Seizure\"><\/span>Rule 9 \u2013 Power to Call for Information, Inspection, Search, and Seizure<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>The Jute Commissioner may:<\/p>\n<ul>\n<li>Require any person to provide information related to their business or trade in jute.<\/li>\n<li>Inspect or seize books of accounts and documents relevant to any suspected violation.<\/li>\n<li>Enter and search premises where contraventions are suspected.<\/li>\n<li>Seize raw jute or jute textiles if violations are found.<\/li>\n<\/ul>\n<p>All searches and seizures are governed by the Code of Criminal Procedure, 1973 (Act 2 of 1974), now Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS).<\/p>\n<h2 id=\"rule-10\"><span class=\"ez-toc-section\" id=\"Rule_10_%E2%80%93_Appeals\"><\/span>Rule 10 \u2013 Appeals<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Any person aggrieved by an order of the Jute Commissioner may:<\/p>\n<ul>\n<li><strong>Appeal to the Central Government within 30 days<\/strong> of receiving the order.<\/li>\n<li>The appeal can still be accepted after 30 days if the appellant shows <strong>sufficient cause for delay.<\/strong><\/li>\n<\/ul>\n<h2 id=\"rule-11\"><span class=\"ez-toc-section\" id=\"Rule_11_%E2%80%93_Penalties\"><\/span>Rule 11 \u2013 Penalties<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Any violation of this Order or non-compliance with directions issued under it is <strong>punishable under Section 7 of the Essential Commodities Act, 1955. <\/strong>Penalties may include <strong>fine, imprisonment, or both<\/strong>, depending on the gravity of the offence.<\/p>\n<h2 id=\"rule-12\"><span class=\"ez-toc-section\" id=\"Rule_12_%E2%80%93_Delegation_of_Powers\"><\/span>Rule 12 \u2013 Delegation of Powers<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>The <strong>Jute Commissioner<\/strong>, with the <strong>prior approval of the Central Government<\/strong>, may delegate all or any of his powers to other officers of the <strong>Central or State Governments<\/strong> for effective enforcement.<\/p>\n<h2 id=\"rule-13\"><span class=\"ez-toc-section\" id=\"Rule_13_%E2%80%93_Repeal_and_Saving\"><\/span>Rule 13 \u2013 Repeal and Saving<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>The <strong>Jute and Jute Textiles Control Order, 2000<\/strong>, stands <strong>repealed<\/strong>.<\/p>\n<ul>\n<li>However, any <strong>actions, rights, penalties, or proceedings<\/strong> under the 2000 Order shall continue to remain valid under the 2016 Order.<\/li>\n<\/ul>\n<h2 id=\"police-role\"><span class=\"ez-toc-section\" id=\"Limited_Police_Role_in_Enforcement_of_the_Control_Order_2016\"><\/span>Limited Police Role in Enforcement of the Control Order, 2016<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>The police force&#8217;s involvement in inspecting or visiting <strong>jute godowns<\/strong> is strictly defined and limited by the Jute and Jute Textiles Control Order:<\/p>\n<ul>\n<li><strong>Initial Restriction:<\/strong> Police officers of any rank <strong>cannot initiate<\/strong> an inspection or visit of a jute godown on their own authority.<\/li>\n<li><strong>Action on Complaint:<\/strong> The police are required to act only <strong>upon a formal complaint<\/strong> received from the <strong>Jute Commissioner<\/strong> or any officer specifically authorized by the Commissioner. In such cases, the police must <strong>extend necessary help and support<\/strong> to the Jute Commissioner&#8217;s team.<\/li>\n<\/ul>\n<p><strong>Delegated Power:<\/strong> For more effective enforcement, the Jute Commissioner has the power to formally empower a police officer of the rank of <strong>Assistant Sub-Inspector (ASI)<\/strong> or <strong>Sub-Inspector (SI)<\/strong> to exercise certain powers under Rule 12 of this Control Order.
