Section 32 &#8211; Acquired Distinctiveness:<\/strong> Notwithstanding initial non-distinctiveness, this section permits the registration of a mark if the applicant can demonstrate that it has attained <strong>acquired distinctiveness<\/strong> through long and continuous use in the marketplace.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"C_Registration_Procedure_and_Proprietor_Rights\"><\/span>C. Registration Procedure and Proprietor Rights<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<ol>\n<li><strong>Sections 18 to 23 &#8211; The Procedure for Registration:<\/strong> These sections delineate the procedural steps required for formal trademark registration:<\/li>\n<\/ol>\n<ul>\n<li><strong>Section 18 \u2013 Application for registration:<\/strong> Delineates who can apply, how to apply, and the Registrar&#8217;s power to accept\/refuse the application.<\/li>\n<li><strong>Section 19 \u2013 Withdrawal of acceptance:<\/strong> Allows the Registrar to withdraw their acceptance of the application in certain cases (e.g., acceptance was made in error). It specifically includes infringement through advertising or application on packaging and labels.<\/li>\n<li><strong>Section 134 \u2013 Jurisdiction of Courts:<\/strong> This section determines the appropriate legal forum, allowing trademark infringement and passing-off suits to be filed in the District Court or High Court within whose jurisdiction the trademark owner resides or carries on business, thereby facilitating access to justice.<\/li>\n<li><strong>Section 135 \u2013 Remedies for infringement:<\/strong> The Act provides comprehensive remedies for infringement, including both civil and criminal actions:<\/li>\n<\/ol>\n<ul>\n<li><strong>Injunctions<\/strong> (court orders to stop misuse);<\/li>\n<li><strong>Damages<\/strong> or an account of profits; and<\/li>\n<li><strong>Delivery-up<\/strong> of infringing goods and materials for destruction.<\/li>\n<\/ul>\n<ol start=\"4\">\n<li><strong>Sections 136 to 140 \u2013 Offences, penalties and procedure:<\/strong> These sections prescribe cognizable offences for falsifying or falsely applying trademarks (S.136), selling or possessing goods with false trademarks (S.137), and making or possessing instruments for falsification (S.138). Penalties include imprisonment up to 3 years, fine, or both, with enhanced punishment (up to 5 years and higher fines) for second\/subsequent convictions. Section 139 provides exemptions (e.g., bona fide use of own name), while Section 140 enables forfeiture of counterfeit goods. Together, they form a robust deterrent framework against trademark counterfeiting and misuse.<\/li>\n<\/ol>\n<h3><span class=\"ez-toc-section\" id=\"E_Who_Will_Investigate\"><\/span>E. Who Will Investigate?<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p><strong>Investigation &amp; search\/seizure authority (Section 115(4)):<\/strong> Any police officer <strong>not below the rank of Deputy Superintendent of Police (DSP) or equivalent<\/strong> may, if satisfied that any cognizable offence under <strong>Sections 103, 104, or 105<\/strong> (falsifying\/applying false trademarks or trade descriptions) has been, is being, or is likely to be committed, <strong>search and seize without warrant<\/strong> the goods, dies, blocks, machines, plates, or other instruments involved. Seized articles must be produced <strong>as soon as practicable<\/strong> before a <strong>Judicial Magistrate of the First Class (JMFC)<\/strong> or <strong>Metropolitan Magistrate<\/strong>.<\/p>\n<p><strong>Key safeguard (Proviso to S.115(4)):<\/strong> The police officer <strong>must obtain the Registrar&#8217;s opinion<\/strong> on the facts relating to the trademark offence <strong>before<\/strong> conducting the search and seizure, and shall abide by it.<\/p>\n<p>The offences under Section 115(4) of the Trademarks Act, 1999\u2014specifically, those under Sections 103 (falsifying a trademark), 104 (falsely applying a trademark), and 105 (applying false trade description)\u2014are cognizable and non-bailable.<\/p>\n<p>Imprisonment for a term which may extend to 3 years, or fine, or both (S.103\u2013105). BNSS classifies &#8220;up to 3 years&#8221; as non-bailable (Bombay HC in <strong>Piyush Ranipa v. State of Maharashtra<\/strong>, 2021; confirmed for similar IP laws).<\/p>\n<h3><span class=\"ez-toc-section\" id=\"F_Section_157_%E2%80%93_Power_to_Make_Rules\"><\/span>F. Section 157 \u2013 Power to Make Rules<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>This section empowers the Central Government to make rules, by notification in the Official Gazette, for carrying out the provisions of the Act. Such rules may provide for matters including the form and manner of applications, fees, procedures for registration, opposition, renewal, appeals, and implementation of international treaties\u2014ensuring the trademark framework remains efficient, effective, and adaptive to evolving business practices and technological advancements.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"G_Conclusion\"><\/span>G.
