When &amp; Who Can File an Appeal<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"21_Time_Limit_for_Filing\"><\/span>2.1 Time Limit for Filing<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Under Section 61 of the Insolvency and Bankruptcy Code, 2016, an appeal to the NCLAT must be filed within <strong>30 days<\/strong> from the date of receipt of the impugned order of the NCLT. The NCLAT may, if satisfied that there was sufficient cause, extend this period by a further <strong>15 days<\/strong>. In effect, the outer limit for filing an appeal under IBC is usually <strong>45 days<\/strong>.<\/p>\n\n\n\n<p>For appeals under other statutes (such as the Companies Act, 2013 or Competition Act), the limitation period will be as prescribed under those specific laws.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"22_Who_Can_File_an_Appeal\"><\/span>2.2 Who Can File an Appeal<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Any &#8220;person aggrieved&#8221; by an order of the NCLT or other competent authority can approach the NCLAT, including:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Financial creditors and operational creditors under the IBC.<\/li>\n\n\n\n<li>Corporate debtors and their promoters or shareholders, where permitted by law.<\/li>\n\n\n\n<li>Resolution professionals, liquidators and insolvency professionals.<\/li>\n\n\n\n<li>Company management, directors and other stakeholders affected by NCLT orders.<\/li>\n\n\n\n<li>Any other person specifically authorized under the relevant statute.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"3_Preparing_the_Appeal_%E2%80%94_Key_Documents_and_Format\"><\/span>3.
