the defendant to be held liable, three specific elements must coexist. If any of these are missing, a legal action for tort will generally fail.<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><th>Element<\/th><th>Core Requirement<\/th><th>Illustration<\/th><\/tr><\/thead><tbody><tr><td>The Wrongful Act or Omission<\/td><td>An act done unlawfully or failure to perform a legal duty<\/td><td>Failing to stop at a red light; failure to fence a dangerous pit<\/td><\/tr><tr><td>Legal Damage<\/td><td>Infringement of a legally protected right<\/td><td>Trespass without actual loss<\/td><\/tr><tr><td>Legal Remedy<\/td><td>Availability of a civil remedy recognized by law<\/td><td>Unliquidated damages<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"wrongful-act-or-omission\"><span class=\"ez-toc-section\" id=\"The_Wrongful_Act_or_Omission\"><\/span>The Wrongful Act or Omission<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>The first requirement is that the defendant must have committed an act that they were not supposed to do, or failed to perform an act that they were legally bound to do (an omission).<\/p>\n\n\n\n<p><strong>Example:<\/strong> A driver failing to stop at a red light (Act) or a municipality failing to fence off a dangerous pit on a public sidewalk (Omission).<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"legal-damage\"><span class=\"ez-toc-section\" id=\"Legal_Damage\"><\/span>Legal Damage<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Not all harm is compensable in court. The plaintiff must prove they suffered &#8220;Legal Damage&#8221;\u2014meaning an infringement of a legal right. The maxim <em>Ubi jus ibi remedium<\/em> (Where there is a right, there is a remedy) governs this principle.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"standard-of-care-and-risk\"><span class=\"ez-toc-section\" id=\"%E2%80%9CStandard_of_Care_Must_Vary_With_the_Risk_Involved%E2%80%9D\"><\/span>\u201cStandard of Care Must Vary With the Risk Involved\u201d<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>In the law of negligence, the &#8220;Standard of Care&#8221; refers to the degree of attentiveness and caution that a reasonable person would exercise under similar circumstances. However, this standard is not a fixed, one-size-fits-all rule. It is a variable standard.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"principle-of-proportionate-care\"><span class=\"ez-toc-section\" id=\"The_Principle_of_Proportionate_Care\"><\/span>The Principle of Proportionate Care<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>The law dictates that as the danger of a situation increases, the precautions required to meet the &#8220;reasonable person&#8221; standard also increase. A person handling a loaded firearm is held to a much higher standard of care than a person handling a walking stick.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"factors-influencing-risk-variation\"><span class=\"ez-toc-section\" id=\"Factors_Influencing_the_Variation_of_Risk\"><\/span>Factors Influencing the Variation of Risk<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Magnitude of Risk<\/strong><br>This includes both the likelihood of injury and the seriousness of the potential injury.<\/li>\n\n\n\n<li>If a task is inherently dangerous (e.g., working with high-voltage electricity), the law demands a higher degree of vigilance.<\/li>\n<\/ul>\n\n\n\n<p><strong>Case Reference:<\/strong> In <em>Paris v. Stepney Borough Council<\/em>, the court held that because the employee was already blind in one eye, the risk of total blindness was so grave that the employer owed a higher standard of care to provide goggles compared to a sighted employee.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"importance-of-object\"><span class=\"ez-toc-section\" id=\"The_Importance_of_the_Object_Social_Utility\"><\/span>The Importance of the Object (Social Utility)<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Sometimes, a high risk is justified if the goal is of great social value. For example, a fire engine or ambulance driver may take risks that a private citizen cannot, because the &#8220;Standard of Care&#8221; adjusts for the urgency of saving lives.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"practicability-of-precautions\"><span class=\"ez-toc-section\" id=\"Practicability_of_Precautions\"><\/span>Practicability of Precautions<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>The law does not demand the impossible. To determine the standard, courts weigh the cost and difficulty of taking precautions against the gravity of the risk. If the risk is slight but the cost of prevention is enormous, the standard of care may be lower.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201cThe care may be \u2018reasonable\u2019 only if it is proportionate to the risk.
