It depends mainly on the information given by the person taking the insurance. So, the insured must <strong>truthfully disclose all important (material) facts<\/strong> at the time of taking the policy.<\/p>\n<p><strong>Simple Examples<\/strong><\/p>\n<ol>\n<li><strong>Health Insurance: <\/strong>If a person already has diabetes but hides this fact while applying for health insurance, it is a breach of <em>uberrima fides<\/em>. The insurer may later <strong>reject the claim or cancel the policy<\/strong>.<\/li>\n<li><strong>Life Insurance: <\/strong>If an applicant is a chain smoker and does not mention it in the proposal form, the insurer is misled. Since smoking affects life expectancy, this non-disclosure violates the principle of utmost good faith.<\/li>\n<li><strong>Motor Insurance: <\/strong>If a vehicle was previously involved in major accidents and this is not disclosed while taking insurance, the policy may become invalid.<\/li>\n<\/ol>\n<p><strong>Position in Indian Law<\/strong><\/p>\n<p>Indian courts have consistently held that <strong>non-disclosure or false disclosure of material facts at the proposal stage<\/strong> allows the insurer to <strong>repudiate the policy<\/strong>. Honesty at the beginning of the insurance contract is therefore essential.<\/p>\n<p>\u00a0In short, <strong>insurance works on trust<\/strong>, and <em>uberrima fides<\/em> ensures that this trust is protected by law.<\/p>\n<p>No major legislative change has abolished or substantially weakened the doctrine of uberrima fides. Section 45 of the Insurance Act, 1938 (as amended) continues to govern repudiation in life insurance, allowing exceptions for fraud even beyond the incontestability period, while the common law principle of utmost good faith remains broadly applicable.<\/p>\n<p><strong>Evolving Judicial Trend<\/strong><\/p>\n<p>Courts increasingly adopt a balanced, consumer-centric approach, especially for common lifestyle conditions (e.g., hypertension, diabetes). Non-disclosure may not always lead to automatic repudiation if the condition is widespread, not fraudulently concealed, or unrelated to the cause of claim. This prevents misuse of the doctrine against genuine policyholders (noted in recent Consumer Commission and Supreme Court observations in 2024\u20132025).<\/p>\n<p><strong>Meaning and Scope of Uberrima Fides<\/strong><\/p>\n<p>Under the doctrine of uberrima fides:<\/p>\n<ul>\n<li>The <strong>insured<\/strong> must disclose all <strong>material facts<\/strong> that may influence the insurer\u2019s decision to accept the risk or determine the premium.<\/li>\n<li>The <strong>insurer<\/strong> must also act fairly by clearly disclosing policy terms, exclusions, and conditions.<\/li>\n<\/ul>\n<p>A <strong>material fact<\/strong> is one which would affect the judgment of a prudent insurer in deciding whether to accept the risk or on what terms.<\/p>\n<p><strong>Why Uberrima Fides is Crucial in Insurance Contracts<\/strong><\/p>\n<p>Insurance contracts are based on:<\/p>\n<ul>\n<li>Asymmetry of information<\/li>\n<li>Trust between parties<\/li>\n<li>Assessment of future uncertainties<\/li>\n<\/ul>\n<p>Since the insurer cannot independently verify every fact at the proposal stage, the law imposes a <strong>duty of absolute good faith<\/strong> on the insured.<\/p>\n<p><strong>Illustrative Examples<\/strong><\/p>\n<p><strong>Example 1: Life Insurance<\/strong><\/p>\n<p>A person suffering from chronic heart disease takes a life insurance policy but fails to disclose his medical history in the proposal form. When hospitalization occurs due to diabetic complications, the insurer may lawfully repudiate the claim due to <strong>non-disclosure of a material fact<\/strong>.<\/p>\n<p><strong>Example 3: Motor Insurance<\/strong><\/p>\n<p>If a vehicle owner fails to disclose that the vehicle is used for commercial purposes while insuring it as a private vehicle, the insurer can deny liability for breach of <strong>utmost good faith<\/strong>.<\/p>\n<p><strong>Consequences of Breach of Uberrima Fides<\/strong><\/p>\n<p>If the doctrine is violated:<\/p>\n<ul>\n<li>The insurer may <strong>repudiate the claim<\/strong><\/li>\n<li>The insurance contract may become <strong>voidable<\/strong><\/li>\n<li>Courts may deny relief even if the loss is otherwise genuine<\/li>\n<\/ul>\n<p>However, repudiation must be based on <strong>clear proof of material suppression<\/strong>, not on trivial or unrelated omissions.<\/p>\n<p><strong>Landmark Indian Case Laws<\/strong><\/p>\n<ol>\n<li><strong> LIC of India v. Asha Goel (2001) 2 SCC 160<\/strong><\/li>\n<\/ol>\n<p>The Supreme Court held that repudiation of a life insurance claim must be based on <strong>clear and cogent evidence of suppression of material facts<\/strong>.
