A defining feature of these reforms is the mandatory transition from unlimited-term contracts to a standardized fixed-term model, a shift the UAE judiciary has consistently upheld to ensure contractual clarity.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"fixed-term-full-time-employment\"><span class=\"ez-toc-section\" id=\"Fixed-Term_Full-Time_Employment\"><\/span>Fixed-Term (Full-Time) Employment<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This is the standard model for the UAE private sector. Under Article 8, all contracts must be written, registered with the Ministry of Human Resources and Emiratisation (MOHRE), and prepared in Arabic (with legal translations).<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><th>Aspect<\/th><th>Legal Requirement<\/th><\/tr><\/thead><tbody><tr><td><strong>Duration<\/strong><\/td><td>Originally capped at three years, Federal Decree-Law No. 14 of 2022 removed this limit. Termination requires proof that the project has genuinely concluded or been cancelled.<\/li>\n\n\n\n<li><strong>Flexible Work:<\/strong> Hours or days vary based on operational needs. Courts monitor these closely to prevent &#8220;misclassification,&#8221; ensuring workers receive statutory benefits if the employer exerts substantial control.<\/li>\n\n\n\n<li><strong>Remote\/Teleworking:<\/strong> A formalized framework for digital work. UAE courts maintain jurisdiction over these contracts provided they are registered with MOHRE, even if the work is performed abroad.<\/li>\n\n\n\n<li><strong>Casual\/Occasional:<\/strong> For short-term engagements (e.g., event staffing). These workers remain covered by overtime and workplace injury protections.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"termination-gratuity-non-compete\"><span class=\"ez-toc-section\" id=\"Termination_Gratuity_And_Non-Compete\"><\/span>Termination, Gratuity, And Non-Compete<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"termination-and-dismissal\"><span class=\"ez-toc-section\" id=\"Termination_And_Dismissal_Articles_44_47\"><\/span>Termination And Dismissal (Articles 44 &amp; 47)<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Summary dismissal (without notice) is strictly limited to &#8220;gross misconduct&#8221; under Article 44. Crucially, a written internal investigation is now a mandatory prerequisite for dismissal. To be covenants for a maximum of 2 enforceable, these must be specific in geographic scope and nature of work. Claims for breach must be filed within one year of discovery.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"modern-dispute-resolution\"><span class=\"ez-toc-section\" id=\"Modern_Dispute_Resolution_2024_Update\"><\/span>Modern Dispute Resolution (2024 Update)<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Federal Decree-Law No. 9 of 2024 has revolutionized legal efficiency by granting MOHRE the power to issue final, binding decisions on claims valued at AED 50,000 or less. These decisions have the power of a court writ (execution), allowing for rapid enforcement without lengthy litigation.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"universal-employee-protections\"><span class=\"ez-toc-section\" id=\"Universal_Employee_Protections\"><\/span>Universal Employee Protections<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Regardless of contract type, the following rights are non-negotiable:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Passport Security:<\/strong> Confiscation is strictly prohibited and carries criminal penalties.<\/li>\n\n\n\n<li><strong>Wage Protection:<\/strong> All salaries must be paid through the WPS (Wage Protection System).<\/li>\n\n\n\n<li><strong>No Pre-employment Waivers:<\/strong> Employees cannot legally waive statutory rights (like gratuity) before or during employment.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"conclusion\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The UAE\u2019s contemporary framework successfully balances economic agility with rigorous judicial oversight.
