The mother was permanently based in France, while the children\u2019s schooling and day-to-day life were firmly established in Dubai.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Mother residing permanently outside the UAE<\/li>\n\n\n\n<li>Children\u2019s education based in Dubai<\/li>\n\n\n\n<li>Logistical difficulties in travel and coordination<\/li>\n\n\n\n<li>Disruption to children\u2019s daily routine<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"decision-to-appeal-for-sole-custody\"><span class=\"ez-toc-section\" id=\"Decision_to_Appeal_for_Sole_Custody\"><\/span>Decision to Appeal for Sole Custody<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>For these reasons, the firm asked the father to appeal the custody decision and seek sole custody in the UAE as a more practical and legally sustainable outcome.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"court-of-appeal-analysis\"><span class=\"ez-toc-section\" id=\"Court_Of_Appeal_Analysis_Practical_Workability_Of_Custody\"><\/span>Court Of Appeal Analysis: Practical Workability Of Custody<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Before the Court of Appeal, the legal team concentrated on how the arrangement worked in practice rather than in theory. They submitted that although joint custody may be suitable in principle, it is not workable where one parent is permanently based in another country. The children were settled in Dubai, attending school in Dubai, and also doing well under the father\u2019s care, which was also highlighted by the team.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"custody-committee-review\"><span class=\"ez-toc-section\" id=\"Custody_Committee_Review_And_Findings\"><\/span>Custody Committee Review And Findings<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>The Court of Appeal undertook a detailed review of the case and appointed a specialized custody committee to assess the children\u2019s situation. Hence, the court in its judgment awarded sole custody to the father in Dubai, granting the father full guardianship, including responsibility for the children\u2019s education and healthcare.<\/p>\n\n\n\n<p>The court held that the best interests of the child in the UAE are the overriding consideration and may justify a departure from the default presumption of joint custody.
