However, in the digital age, this principle has taken on new dimensions. Court records are no longer confined to dusty archives; they are instantly searchable, widely disseminated, and permanently accessible online. This permanence can unintentionally stigmatize individuals who have been acquitted or discharged, raising the question: does open justice risk becoming open injustice?<\/p>\n<p><strong>Privacy as a Counterweight<\/strong><\/p>\n<p>The recognition of <strong>privacy as a fundamental right<\/strong>\u2014most notably in <em>Justice K.S. Puttaswamy v. Union of India<\/em> (2017)\u2014has reshaped the legal landscape. Courts now acknowledge that individuals have a right to informational control, including the ability to limit how long sensitive details remain in the public domain. This has led to the emergence of the <strong>\u201cRight to be Forgotten\u201d<\/strong>, where courts permit redaction of names, masking of identifiers, or de-indexing from search engines in cases where continued exposure serves no public interest. The tension lies in balancing this right with the constitutional commitment to transparency.<\/p>\n<p><strong>Global Jurisprudence<\/strong><\/p>\n<ul>\n<li><strong>European Union:<\/strong> The General Data Protection Regulation (GDPR) explicitly recognizes the Right to be Forgotten, allowing individuals to request removal of personal data from search engines and databases.<\/li>\n<li><strong>United States:<\/strong> Courts emphasize First Amendment values, often prioritizing transparency, though debates around sealing records and expungement continue.<\/li>\n<li><strong>India:<\/strong> High Courts have begun granting relief in post-acquittal cases, permitting redaction or masking of names to prevent \u201cdigital stigmatization.\u201d Yet, they also stress that judicial records are public documents, preserving the principle of open justice.<\/li>\n<\/ul>\n<p><strong>Striking the Balance<\/strong><\/p>\n<p>Courts are increasingly adopting a <strong>case-by-case approach<\/strong>:<\/p>\n<ul>\n<li><strong>Transparency preserved<\/strong> in matters of systemic corruption, public safety, or issues of broad societal importance.<\/li>\n<li><strong>Privacy protected<\/strong> in cases of acquittal, minor offences, or sensitive allegations where continued exposure causes disproportionate harm. He has attended Indian government sponsored specialized training in police and management matters in SVPNPA, Hyderabad, IIM, Ahmedabad and Singapore. He is the author of the books 'Police Investigation &amp; Allied Matters' and 'Alternative Dispute Resolution: Evolving Trends and Innovations' demonstrating his commitment to knowledge sharing within the law enforcement field. As an observer for the Election Commission of India, he has gained firsthand experience in conducting assembly elections and bye-elections in Uttar Pradesh, Rajasthan, Assam, Bihar, and Tripura (twice). He has also completed Post Graduate Diplomas in Human Rights, Project Management, Corporate Management, Computer Application, Public Administration, Medical Law, Disaster Management, Fire Safety &amp; Hazards Management and Psychology. He has attended Indian government sponsored specialized training in police and management matters in SVPNPA, Hyderabad, IIM, Ahmedabad and Singapore. He is the author of the books 'Police Investigation &amp; Allied Matters' and 'Alternative Dispute Resolution: Evolving Trends and Innovations' demonstrating his commitment to knowledge sharing within the law enforcement field. As an observer for the Election Commission of India, he has gained firsthand experience in conducting assembly elections and bye-elections in Uttar Pradesh, Rajasthan, Assam, Bihar, and Tripura (twice).
