Numerous users make copies of the identical video formats, frames, editing styles, and concepts that have originated by original creators. In multiple instances, the whole content is copied or significantly duplicated by an individual to acquire views, followers, and the benefit of monetization.<\/p>\n\n\n\n<p>This has raised great <a href=\"\/copyright\/register.htm\">Intellectual Property Rights<\/a> (IPR) issues because the boundary between inspiration and infringement issues is being highly blurred. The rampant application of copying the same frame or trend-based content brings to the fore serious concerns of safeguarding originality and the right of copying writers in the digital era.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"meaning-of-content-theft\"><span class=\"ez-toc-section\" id=\"Meaning\"><\/span>Meaning<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Content theft refers to the unauthorized use, reproduction, or distribution of another person\u2019s original work without permission. On social media, this includes downloading and re-uploading videos, copying captions, using audio without authorization, or imitating creative content for personal gain.<\/p>\n\n\n\n<p>In recent times, a common trend is the making of \u2018remix\u2019 or \u2018recreated\u2019 videos, where users take an original creator\u2019s content (such as reels, dance videos, dialogues, or formats) and reproduce it with slight modifications. This is particularly prevalent on YouTube, where creators copy others&#8217; videos to earn money through their channels. <a href=\"https:\/\/www.legalserviceindia.com\/Legal-Articles\/the-copyright-act-safeguarding-creativity-and-cultural-expression\/\" type=\"post\" id=\"7614\">The Copyright Act<\/a>, No. 14 of 1957, \u00a7 14, INDIA CODE (1957).<\/p>\n\n\n\n<p>The second problem is plagiarism, where users plagiarize other people&#8217;s scripts, ideas, and style. In such scenarios, one person comes up with a new way of filming their reels, videos, challenges, etc., which then become viral among other people who also replicate them.<\/p>\n\n\n\n<p>For example, someone might come up with a unique kind of transition video or format of storytelling on Instagram, where soon there will be several other users doing the same thing for monetary gains.<\/p>\n\n\n\n<p>Now from an intellectual property rights perspective, this is not necessarily a case of infringement because IPR laws protect the expression of an idea, not an idea itself. It thus makes perfect sense for people to follow a certain trend.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"legal-framework\"><span class=\"ez-toc-section\" id=\"Legal_Framework\"><\/span>Legal Framework<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>In India the protection of such content is governed by the Copyright Act, 1957, which grants creators exclusive rights over their work. Under Section 14 the copyright owner has the exclusive right to reproduce, distribute, communicate to the public, and adapt their work.<\/p>\n\n\n\n<p>Further, Section 51 provides that copyright is infringed when any person, without authorization, uses the work in a manner reserved for the owner.
