Justice M. Nagaprasanna ordered the immediate release of a man who had been in custody for 42 days based on allegations of sexual intercourse on a false promise of marriage. The Court also stayed further investigation in the matter.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"court-observation-on-misuse\"><span class=\"ez-toc-section\" id=\"Court_Observation_on_Misuse_of_Law\"><\/span>Court Observation on Misuse of Law<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>While granting relief, the court made a strong observation:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201cThe litigation is with regard to misuse of Section 69 of the BNS and mushrooming of cases before this Court by the day, and in all cases where the relationship ends in a breakup, the man is in the lockup. Therefore, it is necessary for this Court to direct release of the petitioner forthwith.\u201d<\/p>\n<\/blockquote>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"consensual-relationship-finding\"><span class=\"ez-toc-section\" id=\"Court_Finds_Relationship_Was_Consensual\"><\/span>Court Finds Relationship Was Consensual<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>The Court carefully examined the complaint and found that the relationship between the parties was consensual throughout. It noted that there was no allegation of force or coercion at any point.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201cAll consensual, as not a word of allegation of sexual assault by the petitioner against the complainant is narrated.\u201d<\/p>\n<\/blockquote>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"supreme-court-precedents\"><span class=\"ez-toc-section\" id=\"Reliance_on_Supreme_Court_Precedents\"><\/span>Reliance on Supreme Court Precedents<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>The bench relied on precedents laid down by the Supreme Court in the following cases:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Dr Dhruvaram Murlidhar Sonar v. State of Maharashtra<\/li>\n\n\n\n<li>Samadhan v. State of Maharashtra<\/li>\n<\/ul>\n\n\n\n<p>These judgements clearly distinguish between breach of promise and criminal intent.
