The present controversy arising out of the Special Intensive Revision (SIR) of electoral rolls in West Bengal falls unmistakably in the latter category.<\/p>\n\n\n\n<p>Justice Joymalya Bagchi\u2019s pointed query\u2014\u201cIf the winning margin is 2% and 15% of the electorate could not vote, what happens then?\u201d\u2014is not a casual courtroom remark. It is, in my considered opinion, a constitutional warning shot, aimed at preserving the foundational principle of free and fair elections, which forms part of the basic structure of the Constitution.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"legal-framework\"><span class=\"ez-toc-section\" id=\"The_Legal_Framework_Power_Of_The_Election_Commission\"><\/span>The Legal Framework: Power Of The Election Commission<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The Election Commission of India (ECI) derives its authority primarily from:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Article 324 of the Constitution of India<\/strong> \u2014 Vesting superintendence, direction, and control of elections<\/li>\n\n\n\n<li><strong>Representation of the People Act, 1950<\/strong> \u2014 Governing preparation and revision of electoral rolls<\/li>\n\n\n\n<li><strong>Representation of the People Act, 1951<\/strong> \u2014 Governing conduct of elections and election disputes<\/li>\n<\/ul>\n\n\n\n<p>There is no quarrel with the proposition that the ECI is empowered\u2014indeed, duty-bound\u2014to ensure the purity of electoral rolls. However, the present case raises a more nuanced question:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>Can the exercise of such power, if resulting in large-scale exclusion of voters, undermine the very democratic legitimacy it seeks to protect?<\/p>\n<\/blockquote>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"west-bengal-sir-controversy-brief\"><span class=\"ez-toc-section\" id=\"What_Happened_In_West_Bengal_The_Controversy_In_Brief\"><\/span>What Happened In West Bengal: The Controversy In Brief<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The special intensive revision exercise in West Bengal reportedly resulted in the following:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Mass deletion of voter names running into millions<\/li>\n\n\n\n<li>Introduction of a new category termed \u201clogical discrepancy\u201d<\/li>\n\n\n\n<li>Requirement of additional documentation for previously enrolled voters<\/li>\n<\/ul>\n\n\n\n<p>More troublingly, it was argued before the court that:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Even after adjudication, a substantial percentage of exclusions remained intact<\/li>\n\n\n\n<li>The appellate and verification mechanisms were overburdened and imperfect<\/li>\n<\/ul>\n\n\n\n<p>This triggered judicial concern not merely about administrative efficiency but about systemic disenfranchisement.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"justice-bagchi-observations\"><span class=\"ez-toc-section\" id=\"Justice_Bagchis_Observations_A_Doctrinal_Shift_In_The_Making\"><\/span>Justice Bagchi\u2019s Observations: A Doctrinal Shift In The Making<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"electoral-legitimacy\"><span class=\"ez-toc-section\" id=\"1_Electoral_Legitimacy_And_Quantitative_Disenfranchisement\"><\/span>1. Electoral Legitimacy And Quantitative Disenfranchisement<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>The most significant contribution of the hearing lies in the articulation\u2014albeit at a preliminary stage\u2014of what may evolve into a new doctrine:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>If the number of excluded voters exceeds or substantially impacts the victory margin, the legitimacy of the election itself may be called into question.<\/p>\n<\/blockquote>\n\n\n\n<p>Traditionally, election law under Section 100 of the Representation of the People Act, 1951, focuses on:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Corrupt practices<\/li>\n\n\n\n<li>Improper acceptance or rejection of nominations<\/li>\n\n\n\n<li>Material effect on the result<\/li>\n<\/ul>\n\n\n\n<p>However, systemic voter exclusion has not been explicitly recognised as a ground. Justice Bagchi\u2019s observation opens the door for a jurisprudential expansion\u2014what I would describe as the \u201cQuantitative Disenfranchisement Test&#8221;.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"deviation-bihar-west-bengal\"><span class=\"ez-toc-section\" id=\"2_Deviation_From_Established_Practice_Bihar_Vs_West_Bengal\"><\/span>2. Human Error And Administrative Realities<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Officers handling hundreds or thousands of cases daily<\/li>\n\n\n\n<li>Even 70% accuracy considered acceptable administratively<\/li>\n<\/ul>\n\n\n\n<p>However:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>In matters of voting rights, even a small percentage of error can translate into massive democratic distortion.<\/p>\n<\/blockquote>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"due-process\"><span class=\"ez-toc-section\" id=\"4_Due_Process_And_The_Right_To_Be_Heard\"><\/span>4.
