The court made it clear that cases without clear and specific allegations cannot be allowed to continue.<\/p>\n\n\n\n<p>The matter came before a bench of Justices Rajesh Bindal and Vijay Bishnoi, where the husband had challenged a Delhi High Court order that allowed the domestic violence case to proceed despite an earlier settlement between both parties.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"supreme-court-observation\"><span class=\"ez-toc-section\" id=\"Supreme_Courts_Key_Observation\"><\/span>Supreme Court\u2019s Key Observation<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201cA criminal complaint regarding domestic violence, with mere reference to the names of the family members or the husband without any specific allegation that points towards their active involvement in commission of such an act of violence, shall be nipped in the bud.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p>The court found the domestic violence case to be an \u201cafterthought\u201d.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201cWhile we are conscious of the fact that the parties to a long standing marital dispute are often fuelled by emotions, we cannot allow such emotions to take a drastic turn in as much as allowing the bursts of emotions to form the basis of criminal prosecution.
