class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>MUMBAI: Justice S. G. Chapalgaonkar of the Bombay High Court at Aurangabad passed an important order in a matrimonial dispute and explained when a husband can seek psychiatric examination of his wife in divorce proceedings.<\/p>\n\n\n\n<p>The case came before the High Court after a trial court had allowed the husband\u2019s request for medical examination of the wife through an expert psychiatrist.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"husband-allegations\"><span class=\"ez-toc-section\" id=\"Husbands_Allegations\"><\/span>Husband\u2019s Allegations<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The husband had filed a divorce case under Section 13 of the Hindu Marriage Act on the grounds of cruelty, desertion, and mental disorder.<\/li>\n\n\n\n<li>He claimed that after marriage, the wife\u2019s behaviour was abnormal.<\/li>\n\n\n\n<li>She was not willing to have marital relations.<\/li>\n\n\n\n<li>She was secretly taking medicines.<\/li>\n\n\n\n<li>Her parents had hidden her mental condition before marriage.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"wife-defense\"><span class=\"ez-toc-section\" id=\"Wifes_Defense\"><\/span>Wife\u2019s Defense<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>The wife denied all allegations and told the court that she was mentally fit and not suffering from any illness.<\/p>\n\n\n\n<p>During the divorce case, the husband requested that she be sent for a psychiatric examination so that the truth could come on record.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"trial-court-decision\"><span class=\"ez-toc-section\" id=\"Trial_Court_Decision\"><\/span>Trial Court Decision<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The trial court accepted this request.<\/li>\n\n\n\n<li>Directed her to appear before an expert psychiatrist at Civil Hospital, Dhule.<\/li>\n\n\n\n<li>Asked for a confidential report.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"high-court-challenge\"><span class=\"ez-toc-section\" id=\"Challenge_Before_High_Court\"><\/span>Challenge Before High Court<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The wife challenged that order before the Bombay High Court. Her side argued the following:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The lower court passed the order mechanically.<\/li>\n\n\n\n<li>There was no material to show any mental illness.<\/li>\n\n\n\n<li>Such an order should not be passed based only on allegations.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"legal-principles\"><span class=\"ez-toc-section\" id=\"Legal_Principles_Discussed\"><\/span>Legal Principles Discussed<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>After hearing both sides, Justice S. G. Chapalgaonkar examined the law and referred to the Supreme Court judgement in Sharda vs Dharmpal.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201cMatrimonial Court has power to order a person to undergo a medical test, and the passing of such an order by the court would not be in violation of the right to personal liberty under Article 21 of the Constitution of India.\u201d<\/p>\n<\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>&#8220;The court should exercise such power if the applicant has a strong prima facie case and there is sufficient material before the court. If, despite the order of the court, the respondent refuses to submit himself or herself for medical examination, the court will be entitled to draw an adverse inference against him\/her.\u201d<\/p>\n<\/blockquote>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"high-court-observations\"><span class=\"ez-toc-section\" id=\"High_Court_Observations\"><\/span>High Court Observations<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The trial court had not properly examined whether enough material existed.<\/li>\n\n\n\n<li>The order lacked proper reasoning and application of mind.<\/li>\n\n\n\n<li>Courts should not casually direct medical examination merely because one side makes allegations.<\/li>\n<\/ul>\n\n\n\n<p>The High Court said that in such matters, the husband must first place evidence on record to show that examination is necessary to determine whether the spouse suffers from the required degree of unsoundness of mind or whether the condition is incurable.
