Acquittal in a criminal case filed by the wife is not one of those reasons.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"key-legal-finding\"><span class=\"ez-toc-section\" id=\"Key_Legal_Finding\"><\/span>Key Legal Finding<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201cThe plea of acquittal from criminal prosecution under Section 498-A in itself is not a ground to deny the maintenance to the wife or minor children if it is proved that they are unable to maintain themselves and the husband has sufficient means and neglects maintenance.\u201d<\/p>\n<\/blockquote>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"background-of-the-case\"><span class=\"ez-toc-section\" id=\"Background_of_the_Case\"><\/span>Background of the Case<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The matter came before the High Court after a family court granted \u20b97,000 monthly maintenance to the wife and \u20b93,000 to the minor child. Both husband and wife challenged the order.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The husband argued that acquittal in the Section 498A IPC case should remove his obligation.<\/li>\n\n\n\n<li>The wife sought continuation of maintenance support.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"court-reasoning\"><span class=\"ez-toc-section\" id=\"Courts_Reasoning\"><\/span>Court\u2019s Reasoning<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>However, the High Court rejected this argument. It said Section 125 CrPC is meant for social justice and to prevent financial hardship for dependants who cannot maintain themselves.<\/p>\n\n\n\n<p>The law is not meant to punish anyone but to ensure basic support.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"proof-required-for-maintenance\"><span class=\"ez-toc-section\" id=\"Proof_Required_for_Maintenance\"><\/span>Proof Required for Maintenance<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201cFor maintenance, the wife and minor child have to prove only that they are unable to maintain themselves and the person against whom the application has been preferred has sufficient means and he neglects or refuses to maintain, and nothing more is to be proved by the applicants, and for that purpose, no strict standard of proof is required, as proceedings under Section 125 of the Cr.P.C. are summary in nature.\u201d<\/p>\n<\/blockquote>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"impact-of-acquittal\"><span class=\"ez-toc-section\" id=\"Impact_of_Acquittal_on_Maintenance\"><\/span>Impact of Acquittal on Maintenance<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The bench further said the result of a criminal case, whether conviction or acquittal, does not automatically decide maintenance rights.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"when-maintenance-can-be-denied\"><span class=\"ez-toc-section\" id=\"When_Maintenance_Can_Be_Denied\"><\/span>When Maintenance Can Be Denied<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Under Section 125(4) CrPC, a wife can be denied maintenance only under the following conditions:<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><th>Condition<\/th><th>Explanation<\/th><\/tr><\/thead><tbody><tr><td>Living in adultery<\/td><td>If the wife is proven to be in an adulterous relationship<\/td><\/tr><tr><td>Refusal to live with husband<\/td><td>Without valid or reasonable cause<\/td><\/tr><tr><td>Mutual separation<\/td><td>If both parties agree to live separately<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"court-clarification\"><span class=\"ez-toc-section\" id=\"Court_Clarification\"><\/span>Court Clarification<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201cThe above provision of Section 125(4) of Cr.P.C. and Section 144(4) of the BNSS does not envisage that acquittal of the husband from criminal proceedings lodged on the report of the wife would provide any exception to deny the maintenance to the wife or minor child. The only effect may be that he may put the acquittal only for the purpose that he is not neglecting or refusing the wife to maintain.\u201d<\/p>\n<\/blockquote>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"important-observation\"><span class=\"ez-toc-section\" id=\"Important_Observation_by_the_Court\"><\/span>Important Observation by the Court<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The High Court also noted that acquittal can happen for many reasons, such as:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Weak evidence<\/li>\n\n\n\n<li>Technical gaps<\/li>\n\n\n\n<li>Settlement between parties<\/li>\n<\/ul>\n\n\n\n<p>It does not always mean allegations were false, nor does it prove that maintenance duty was fulfilled.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"conclusion\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Acquittal in a Section 498A case does not automatically relieve a husband from his legal obligation to provide maintenance.
