The law is not written to create a lifetime veto in the hands of one spouse.<\/p>\n\n\n\n<p>The real problem is not that the law gives a wife permanent power to deny divorce. The real problems are delay, weak pleadings, poor evidence, avoidable procedural mistakes, and the confusion many husbands have between mutual consent divorce and contested divorce. Those are not the same battle.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"mutual-consent-divorce-section-13b\"><span class=\"ez-toc-section\" id=\"Mutual_Consent_Divorce_Section_13B_Explained\"><\/span>Mutual Consent Divorce: Section 13B Explained<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Under <a href=\"https:\/\/www.legalserviceindia.com\/Legal-Articles\/mutual-consent-divorce-know-the-process-and-benefits\/\" type=\"post\" id=\"5425\">Section 13B, mutual consent <\/a>requires both parties to move together, and the court passes a decree only when the statutory requirements are met and the petition is not withdrawn in the meantime.<\/p>\n\n\n\n<p>That is why the first hard truth must be stated clearly: if the case is for a mutual consent divorce, the wife can stop that route by withdrawing consent before the decree is passed. The Supreme Court has reaffirmed that mutual consent must continue till the decree. That is wrong.<\/p>\n\n\n\n<p>The Supreme Court position is settled. A court cannot convert a broken mutual-consent attempt into a decree merely because one side once agreed.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201cMutual consent should continue till the divorce decree is passed.\u201d<\/p>\n<\/blockquote>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"cooling-off-period\"><span class=\"ez-toc-section\" id=\"Cooling-Off_Period_Exception\"><\/span>Cooling-Off Period Exception<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>The Supreme Court in Amardeep Singh v. Harveen Kaur held that the cooling-off period under Section 13B(2) is directory, not mandatory, and can be waived in appropriate cases.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"cruelty-ground-explained\"><span class=\"ez-toc-section\" id=\"Cruelty_Most_Powerful_Ground\"><\/span>Cruelty: Most Powerful Ground<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Cruelty is the most frequently used and most misunderstood ground. It is not confined to physical violence. Mental cruelty is enough.<\/p>\n\n\n\n<p>The Supreme Court in Samar Ghosh v.
