The transition from the Indian Evidence Act (IEA), 1872, to the Bharatiya Sakshya Adhiniyam (BSA), 2023, represents India’s official acknowledgement of the digital epoch. By elevating electronic records to the status of primary evidence under Section 57, the legislature has modernised the “form” of evidence. However, the “substance” of evidence remains under existential threat.<\/p>
