Introduction<\/strong><\/p>\n

Marriage in Islam is a sacred contract founded on love, mercy, companionship, and mutual respect. The Holy Qur\u2019an describes spouses as \u201cgarments\u201d for one another, offering protection, comfort, and dignity (Qur\u2019an 2:187). Yet Islam recognises that not every marriage endures harmoniously. When irreconcilable differences arise and peaceful coexistence becomes impossible, Islamic law provides lawful avenues for dissolution. One such important mechanism is Khula<\/strong>, a form of divorce initiated by the wife.<\/p>\n

Khula embodies Islam\u2019s commitment to justice, dignity, and individual well-being. It empowers a Muslim woman to seek release from a marriage that has become unbearable, even if the husband is unwilling to grant divorce, reflecting the faith\u2019s balanced approach to marital rights.<\/p>\n

Meaning of Khula<\/strong><\/p>\n

The term \u201cKhula\u201d derives from the Arabic root kh-l-\u2018<\/em>, meaning \u201cto remove\u201d or \u201cto take off”, akin to removing a garment. In Islamic jurisprudence, it refers to the dissolution of marriage at the wife\u2019s instance, typically involving her offer of compensation to the husband \u2014 most commonly the return of the dower (mahr<\/em>) or an equivalent consideration.<\/p>\n

While classical Khula often involves mutual agreement, many jurists and modern courts allow judicial intervention when the husband\u2019s refusal causes undue hardship. Khula differs fundamentally from Talaq (husband-initiated divorce) and Faskh (judicial dissolution on specific grounds under statutes like India\u2019s Dissolution of Muslim Marriages Act, 1939).<\/p>\n

Qur\u2019anic Foundation of Khula<\/strong><\/p>\n

The primary Qur\u2019anic basis for Khula is found in Surah Al-Baqarah:<\/p>\n

\u201cAnd it is not lawful for you (men) to take back anything of what you have given them unless both fear that they cannot keep within the limits of Allah. If you fear that they cannot keep within the limits of Allah, then there is no blame upon either of them concerning that by which she ransoms herself.\u201d (Qur\u2019an 2:229)<\/p>\n

The limits of Allah are often interpreted by jurists as the ability to fulfil marital obligations with a spirit of kindness and performed duties. If the hatred (karahiyyah<\/em>) is so great that they can no longer treat each other with the respect Islam demands, they have “transgressed the limits”.<\/p>\n

This verse establishes that while a husband generally cannot reclaim gifts or mahr upon divorce, an exception exists when the marriage risks violating Allah\u2019s limits. In such cases, the wife may \u201cransom\u201d herself through compensation, enabling a fair and peaceful separation. The emphasis is on mutual concern for piety and harmony rather than trapping spouses in discord.<\/p>\n

Khula in Hadith<\/strong><\/p>\n

A well-known Prophetic example is the case of Jamilah bint Thabit, wife of Thabit ibn Qays (recorded in Sahih al-Bukhari). She approached the Prophet Muhammad (peace be upon him) and said:<\/p>\n

\u201cO Messenger of Allah, I do not complain about Thabit\u2019s character or religion, but I dislike remaining with him in marriage.\u201d<\/p>\n

The Prophet enquired whether she would return the garden given to her as mahr. Upon her agreement, he directed Thabit to accept it and release her. This Hadith demonstrates that Khula can be granted on grounds of genuine aversion (karahiyyah<\/em>), even without fault on the husband\u2019s part.<\/p>\n

Views of Islamic Jurists<\/strong><\/p>\n

All major schools of Islamic jurisprudence (Hanafi, Maliki, Shafi\u2019i, and Hanbali) recognise Khula as valid.<\/p>\n
