This article explores how media coverage, amplified by social media, impacts the accused, drawing on comparative legal principles and landmark precedents.<\/p>\n<p><strong>The Erosion of the Presumption of Innocence<\/strong><\/p>\n<p>The <strong>presumption of innocence\u2014foundational<\/strong>\u00a0to the spirit of Article 21 of the Indian Constitution and Article 11 of the Universal Declaration of Human Rights\u2014is the cornerstone of criminal justice. Ethical journalism must fulfil the mandate of <strong>Article 14<\/strong>\u2014ensuring equality before the law by providing a neutral platform free from prejudice.<\/p>\n<p><strong>The Digital Accelerator: Rise of Social Media<\/strong><\/p>\n<p>The digital era has eliminated the &#8220;cooling-off period&#8221; between an event and its public consumption. Platforms like X (formerly Twitter) and Instagram allow narratives to outpace legal developments.<\/p>\n<ul>\n<li><strong>The Depp-Heard Trial:<\/strong> Demonstrated how &#8220;hashtag justice&#8221; and viral clips can eclipse courtroom proceedings, creating a global public verdict that may differ entirely from the legal one.<\/li>\n<li><strong>The Aryan Khan Case:<\/strong> Showed how social media can become a battleground for competing narratives, forcing the accused to fight for their reputation in the court of public opinion while simultaneously fighting for their liberty in a court of law.<\/li>\n<\/ul>\n<p><strong>Legal Restraints and the Path to Reform<\/strong><\/p>\n<p>To mitigate these risks, jurisdictions use legal &#8220;brakes&#8221; such as the <strong>Contempt of Courts Act, 1971<\/strong> (India), and the <strong>Contempt of Court Act, 1981<\/strong> (UK). He is the author of the books 'Police Investigation &amp; Allied Matters' and 'Alternative Dispute Resolution: Evolving Trends and Innovations' demonstrating his commitment to knowledge sharing within the law enforcement field. As an observer for the Election Commission of India, he has gained firsthand experience in conducting assembly elections and bye-elections in Uttar Pradesh, Rajasthan, Assam, Bihar, and Tripura (twice).
