To address this gap, Parliament enacted the Dissolution of Muslim Marriages Act, 1939, repealing Section 5 of the 1937 Act and creating a clear statutory framework through which Muslim women could seek relief before a court.<\/p>\n<p>The Shariat Act of 1937 originally aimed to replace restrictive customary laws\u2014which often denied women inheritance and divorce\u2014with Islamic principles. This Act was groundbreaking because it adopted the more liberal interpretations of the <strong>Maliki school<\/strong> of jurisprudence, drawing substantially from the broader and more liberal Maliki juristic tradition and making those grounds available through statute to Muslim women generally.<\/p>\n<p>The Act was particularly progressive in its recognition that cruelty includes not only physical violence but also psychological suffering, moral coercion, deprivation of rights, and inequitable marital treatment.<\/p>\n<p><strong>Grounds for Divorce under the DMMA 1939<\/strong><\/p>\n<p>The Act outlines specific circumstances under which a woman can approach a court for the dissolution of her marriage. Always consult local statutes, as legislative amendments frequently evolve to further protect women&#8217;s rights.<\/p>\n<ol start=\"5\">\n<li><strong> Cruelty (<em>Darar<\/em>)<\/strong><\/li>\n<\/ol>\n<p>The Act defines cruelty broadly. It is not limited to physical violence but includes the following:<\/p>\n<ul>\n<li>Associating with &#8220;women of evil repute&#8221;.<\/li>\n<li>Attempting to force the wife into an immoral life.<\/li>\n<li>Disposing of her property or preventing her from exercising legal rights over it.<\/li>\n<li>Obstructing her religious practices.<\/li>\n<li><strong>Inequitable treatment:<\/strong> If a husband has multiple wives and does not treat them equally as commanded by the Quran.<\/li>\n<\/ul>\n<p><strong>Islamic Jurisprudence: The Concept of <em>Faskh<\/em><\/strong><\/p>\n<p>In Islamic law, a judicial divorce initiated by the wife is known as <b><i>&#8216;Faskh&#8217;.<\/i><\/b>\u00a0The DMMA 1939 is essentially a statutory codification of the right to <em>Faskh<\/em>.<\/p>\n<p>Islam views marriage (<em>Nikah<\/em>) as both a sacred covenant and a social contract grounded in mutual rights and obligations. The Qur\u2019an presents marriage (<em>Nikah<\/em>) as a relationship built upon responsibility, kindness, and mutual dignity\u2014not oppression, neglect, or harm.<\/p>\n<p>The obligation of maintenance and protection is expressly recognised in the Qur\u2019an:<\/p>\n<p><strong>\u201cMen are the protectors and maintainers of women, because Allah has given one more strength than the other, and because they support them from their means\u2026\u201d<\/strong><br \/>\n<em>(Qur\u2019an 4:34)<\/em><\/p>\n<p>This verse establishes that financial support, security, and responsible care are central duties within marriage. A husband\u2019s persistent failure to provide maintenance or fulfil essential marital obligations, therefore, constitutes not merely a civil wrong, but a breach of a Qur\u2019anic responsibility.<\/p>\n<p>Likewise, the Qur\u2019an strongly condemns cruelty and unjust treatment in marriage:<\/p>\n<p><strong>\u201cRetain them in kindness or release them in kindness, but do not retain them to harm them\u2026\u201d<\/strong><br \/>\n<em>(Qur\u2019an 2:231)<\/em><\/p>\n<p>And further:<\/p>\n<p><strong>\u201cLive with them in kindness (ma\u2018ruf); for if you dislike them, it may be that you dislike something in which Allah has placed much good.\u201d<\/strong><\/p>\n<p><em>(Qur\u2019an 4:19)<\/em><\/p>\n<p>These verses reinforce a foundational Islamic principle: marriage cannot be used as a means of oppression, coercion, or emotional injury. Where cruelty, abandonment, or injustice destroys the purpose of marriage, Islamic law recognises the legitimacy of dissolution in order to prevent harm (<em>Darar<\/em>).<\/p>\n<p>At its highest ideal, the Qur\u2019an describes marriage as a bond of tranquillity, affection, and mercy:<\/p>\n<p><strong>\u201cAnd among His signs is that He created for you spouses from among yourselves, that you may find tranquillity in them, and He placed between you affection and mercy.\u201d<\/strong><br \/>\n<em>(Qur\u2019an 30:21)<\/em><\/p>\n<p>It is this Qur\u2019anic vision\u2014of marriage as a union founded on <strong>sak\u012bnah (tranquillity), mawaddah (love), and ra\u1e25mah (mercy)<\/strong>\u2014that underlies the spirit of the Dissolution of Muslim Marriages Act, 1939. When a marriage ceases to embody these values and instead becomes a source of suffering, Islamic jurisprudence\u2014and modern law\u2014provides a path toward justice and release.<\/p>\n<p><strong>National and International Case Laws<\/strong><\/p>\n<p>The application of these principles has been shaped by landmark judicial decisions across the globe.<\/p>\n<ol>\n<li><strong> Itwari v. Asghari (India, 1960)<\/strong><\/li>\n<\/ol>\n<p>In this significant case, the court ruled that if a husband takes a second wife, it can constitute &#8220;cruelty&#8221; toward the first wife if it causes her mental anguish. The court emphasised that the Quranic injunction of &#8220;treating wives equally&#8221; is not just a moral guideline but a legal prerequisite.<\/p>\n<ol start=\"2\">\n<li><strong> Abbas Ali v. Afsar Begum (Pakistan)<\/strong><\/li>\n<\/ol>\n<p>The courts in Pakistan have frequently upheld the &#8220;two-year maintenance&#8221; rule. Even if the wife is living separately, if the husband fails to provide support without a legal justification, the court grants the decree of divorce, reinforcing the husband&#8217;s absolute duty to maintain.<\/p>\n<ol start=\"3\">\n<li><strong> Khurshid Bibi v. Muhammad Amin (Supreme Court of Pakistan, 1967)<\/strong><\/li>\n<\/ol>\n<p>This landmark case firmly recognised the principle of judicial <em>Khula<\/em>\u2014a form of divorce initiated by the wife\u2014where marital harmony has irretrievably broken down. The court held that if a Muslim woman finds herself unable to continue the marriage in peace or affection or within the limits prescribed by God, she may seek dissolution even without her husband\u2019s consent, provided she is willing to restore the dower (<em>Mahr<\/em>) or make appropriate restitution.<\/p>\n<ol start=\"4\">\n<li><strong> International Context: The UK and &#8220;Limping Marriages&#8221;<\/strong><\/li>\n<\/ol>\n<p>In jurisdictions like the United Kingdom, the interaction between civil law and Sharia is complex. Courts often see cases where a woman has a civil divorce but the husband refuses to grant a religious divorce (<em>Talaq<\/em>).<\/p>\n<ul>\n<li><strong>Ullah v. Ullah:<\/strong> International legal discourse has shifted toward recognising that withholding a religious divorce can be a form of emotional and spiritual abuse, aligning with the &#8220;Cruelty&#8221; provisions found in the DMMA 1939.<\/li>\n<\/ul>\n<p><strong>Conclusion<\/strong><\/p>\n<p>The Dissolution of Muslim Marriages Act 1939 remains one of the most progressive pieces of legislation for Muslim women in the common law world. By integrating the compassionate interpretations of Islamic Fiqh with a structured legal process, it ensures that marriage remains a bond of &#8220;love and mercy&#8221; rather than a sentence of hardship.<\/p>\n<p>The Act teaches us that the law must be dynamic\u2014it must protect the vulnerable and ensure that the spiritual and legal rights of women are never compromised by neglect or abuse.
