speech. Free speech encourages debate whereas hate speech incites violence.”- By Newton Lee

Freedom of speech and expression is one of the foundational pillars of a democratic and free society. It is a fundamental human right which allows a person to freely express one’s opinions, ideas and access information through any media without interference.

This right ensures that every member of society should have the liberty to form and voice their thoughts and beliefs openly. Without access to free and unfettered speech, democracy is meaningless.

While crucial, free speech isn’t absolute, it is often balanced with restrictions on basis of public order, decency, morality, and more. Speech inciting hatred or hate speech encourages discrimination and violence towards a person or group on basis of religion, race, gender, ethnicity etc.

Hate speech invites illegal activities, harm individual rights and disturbs public peace and order. Such speech is not protected under the garb of freedom of speech and expression. Hate speech not only affects dignity and rights of a single person but also of the whole targeted community.

Freedom of speech and expression is the cornerstone of human rights and securing this freedom is vital for upholding democracy and state accountability. It secures the liberty of thought and expression of an individual, which is essential to living a healthy and dignified life. The Indian Constitution under Article 19(1)(a) guarantees to all its citizens the right of free speech and expression in all forms, but Article 19(2) also enables reasonable restrictions to prevent its misuse and maintain public peace, morality and national integrity.

Hate speech covers all those expressions that incite illegal or harmful acts and whose sole purpose is to encourage violence, aggression, enmity and differences between communities. Such expressions have the potential of disrupting public order, infringing human rights and creating fear and disbelief among individuals. It not only harms the principles of fairness and justice but also shakes the groundwork of a pluralistic society.

However, while regulating hate speech, the right to express dissenting opinions, disapprobation and fair criticism must not be silenced.
