This is because men have seen what happens when a private marital dispute enters the police station, family court and criminal court at the same time.<\/p>\n\n\n\n<p>One failed marriage can bring:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>498A IPC \/ Section 85 BNS criminal case<\/li>\n\n\n\n<li>Domestic Violence Act proceedings<\/li>\n\n\n\n<li>Maintenance claims<\/li>\n\n\n\n<li>Child custody litigation<\/li>\n\n\n\n<li>Dowry allegations<\/li>\n\n\n\n<li>Arrest threats<\/li>\n\n\n\n<li>Social stigma<\/li>\n\n\n\n<li>Workplace damage<\/li>\n\n\n\n<li>Travel restrictions<\/li>\n\n\n\n<li>Settlement pressure<\/li>\n\n\n\n<li>Years of legal expenses<\/li>\n<\/ul>\n\n\n\n<p>That is the real reason more men are afraid of marriage today.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"fear-is-not-imaginary\"><span class=\"ez-toc-section\" id=\"The_Fear_Is_Not_Imaginary\"><\/span>The Fear Is Not Imaginary<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Section 498A IPC has now shifted into Section 85 BNS, with cruelty defined under Section 86 BNS. The punishment remains imprisonment up to three years and fine. The offence continues to create serious criminal exposure for the husband and his relatives.<\/p>\n\n\n\n<p>The Supreme Court in <em>Arnesh Kumar v. State of Bihar<\/em> recognised that arrests in 498A-type cases were being made mechanically and held that police cannot arrest automatically merely because a complaint is filed.<\/p>\n\n\n\n<p>That judgment did not come in vacuum. It came because men and their families were being arrested first and heard later.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"marriage-multi-front-litigation\"><span class=\"ez-toc-section\" id=\"Marriage_Today_Can_Become_Multi-Front_Litigation\"><\/span>Marriage Today Can Become Multi-Front Litigation<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>A man facing matrimonial litigation is often not fighting one case. He may be fighting multiple proceedings at once:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Criminal cruelty case<\/li>\n\n\n\n<li>Dowry case<\/li>\n\n\n\n<li>Domestic Violence Act case<\/li>\n\n\n\n<li>Maintenance under Section 125 CrPC \/ BNSS equivalent provisions<\/li>\n\n\n\n<li>Divorce proceedings<\/li>\n\n\n\n<li>Child custody litigation<\/li>\n\n\n\n<li>Property allegations<\/li>\n\n\n\n<li>Workplace complaints in some situations<\/li>\n<\/ul>\n\n\n\n<p>The law must protect genuine victims. No serious person disputes that.<\/p>\n\n\n\n<p>But the law must also protect innocent men from weaponised litigation. Courts exist for justice, not revenge.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"what-supreme-court-said\"><span class=\"ez-toc-section\" id=\"What_The_Supreme_Court_Has_Actually_Said\"><\/span>What The Supreme Court Has Actually Said<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>In <em>Sushil Kumar Sharma v. Union of India<\/em>, the Supreme Court refused to strike down Section 498A, but clearly warned that misuse of the provision can become \u201clegal terrorism.\u201d<\/p>\n\n\n\n<p>In <em>Preeti Gupta v. State of Jharkhand<\/em>, the Supreme Court expressed concern about exaggerated allegations in matrimonial complaints and the tendency to rope in relatives.<\/p>\n\n\n\n<p>In <em>Social Action Forum for Manav Adhikar v. Union of India<\/td><td>Balance is required between genuine protection and misuse concerns.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"ncrb-data-fear-spread\"><span class=\"ez-toc-section\" id=\"NCRB_Data_Shows_Why_The_Fear_Has_Spread\"><\/span>NCRB Data Shows Why The Fear Has Spread<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>NCRB\u2019s Crime in India 2023 data reported about 1.33 lakh cases under \u201ccruelty by husband or relatives,\u201d forming the largest category of crimes against women at 29.8%.<\/p>\n\n\n\n<p>That number tells two stories at once.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>First, genuine domestic cruelty remains a serious problem.<\/li>\n\n\n\n<li>Second, matrimonial criminal litigation has become one of the largest criminal law categories in India.<\/li>\n<\/ul>\n\n\n\n<p>For men, this means marriage breakdown is not merely emotional failure; it can become criminal exposure.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"arrest-not-automatic\"><span class=\"ez-toc-section\" id=\"Arrest_Is_Not_Supposed_To_Be_Automatic\"><\/span>Arrest Is Not Supposed To Be Automatic<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Under the new BNSS regime, Section 35(3) provides that where arrest is not required, police must issue notice directing the person to appear.<\/p>\n\n\n\n<p>In 2026, the Supreme Court again clarified that for offences punishable up to seven years, notice is the rule and arrest is the exception.<\/p>\n\n\n\n<p>But on the ground, the fear remains:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Police notice<\/li>\n\n\n\n<li>Anticipatory bail pressure<\/li>\n\n\n\n<li>Relatives dragged into litigation<\/li>\n\n\n\n<li>Reputation damage<\/li>\n\n\n\n<li>Compromise pressure before trial<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"maintenance-fear-real\"><span class=\"ez-toc-section\" id=\"Maintenance_Fear_Is_Also_Real\"><\/span>Maintenance Fear Is Also Real<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Many men are not afraid of supporting a genuinely dependent wife or child.<\/p>\n\n\n\n<p>They are afraid of being treated as an ATM despite disputed allegations, concealed income, earning capacity of the wife, short marriages, or parallel litigation pressure.<\/p>\n\n\n\n<p>Indian courts have repeatedly held that financial status, income, earning capacity and disclosure of both parties matter in maintenance litigation.
