Dubai Personal Status Court. The proceedings involved claims relating to divorce, child visitation rights, financial obligations, and deferred dowry payments.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"husbands-claims-before-the-court\"><span class=\"ez-toc-section\" id=\"Husbands_Claims_Before_the_Court\"><\/span>Husband\u2019s Claims Before the Court<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The husband initially approached the court seeking a divorce on the grounds of harm. Alongside the divorce petition, he requested extensive visitation rights concerning the couple\u2019s 8-year-old daughter.<\/p>\n\n\n\n<p>His demands included:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Weekly visitation with overnight stays from Friday evening until Sunday evening.<\/li>\n\n\n\n<li>Time with the child on her birthday.<\/li>\n\n\n\n<li>Access during half of the school holidays.<\/li>\n\n\n\n<li>Custody access during the first day of official holidays such as Eid and National Day.<\/li>\n\n\n\n<li>Daily communication through phone and video calls.<\/li>\n\n\n\n<li>A court direction requiring the mother to hand over the child\u2019s passport and official documents.<\/li>\n\n\n\n<li>Recognition as the child\u2019s educational guardian.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"wifes-counterclaim-and-financial-demands\"><span class=\"ez-toc-section\" id=\"Wifes_Counterclaim_and_Financial_Demands\"><\/span>Wife\u2019s Counterclaim and Financial Demands<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The wife contested the husband\u2019s claims and filed a counterclaim seeking divorce on the grounds of harm as well. She also requested several financial entitlements, including:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Deferred dowry payment.<\/li>\n\n\n\n<li>Spousal maintenance.<\/li>\n\n\n\n<li>Child maintenance.<\/li>\n\n\n\n<li>Childcare and education expenses.<\/li>\n\n\n\n<li>Transportation costs.<\/li>\n\n\n\n<li>Utility bills.<\/li>\n\n\n\n<li>Salaries for domestic staff and drivers.<\/li>\n\n\n\n<li>Other necessary living expenses.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"decision-of-the-court-of-first-instance\"><span class=\"ez-toc-section\" id=\"Decision_of_the_Court_of_First_Instance\"><\/span>Decision of the Court of First Instance<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The trial court dissolved the marriage through a first irrevocable divorce and directed the wife to observe the statutory waiting period, commonly referred to as the \u201cIddah\u201d period under Islamic personal status law.<\/p>\n\n\n\n<p>Under UAE law, during this waiting period, the husband retains the right to reconcile with his wife without requiring a new marriage contract or fresh dowry payment, provided the reconciliation is formally registered before the competent court within 15 days.<\/p>\n\n\n\n<p>The court also ordered that the husband be granted visitation rights with his daughter under conditions deemed appropriate by the court. He argued that the judgement was legally flawed and sought broader visitation rights.<\/p>\n\n\n\n<p>After attempts at reconciliation between the parties failed, the appellate court modified portions of the judgment relating to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Eid visitation arrangements.<\/li>\n\n\n\n<li>Custody-related holiday schedules.<\/li>\n\n\n\n<li>Telephonic and electronic communication timings.<\/li>\n<\/ul>\n\n\n\n<p>The appellate court, however, upheld the remaining findings of the lower court.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"court-of-cassation-rejects-fathers-appeal\"><span class=\"ez-toc-section\" id=\"Court_of_Cassation_Rejects_Fathers_Appeal\"><\/span>Court of Cassation Rejects Father\u2019s Appeal<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The husband subsequently filed Cassation Appeal No. 692\/2025 before the Dubai Court of Cassation, primarily objecting to the refusal to grant overnight visitation during public holidays and the child\u2019s birthday.<\/p>\n\n\n\n<p>He argued that:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>He shared a close emotional bond with his daughter.<\/li>\n\n\n\n<li>Overnight stays would strengthen the parent-child relationship.<\/li>\n\n\n\n<li>He had arranged for a nanny to ensure proper overnight care.<\/li>\n\n\n\n<li>Limited daytime visitation was insufficient for meaningful parenting.<\/li>\n<\/ul>\n\n\n\n<p>Despite these arguments, the Court of Cassation upheld the earlier rulings.<\/p>\n\n\n\n<p>The court clarified that while UAE law recognises the rights of both parents to maintain contact with their children, the exact visitation structure remains a factual matter to be determined by the trial court according to the child\u2019s welfare and best interests.<\/p>\n\n\n\n<p>The court further observed that appellate review cannot interfere with such discretionary findings unless there is a clear legal error or absence of reasoning.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"dowry-dispute-and-cryptocurrency-transfer\"><span class=\"ez-toc-section\" id=\"Dowry_Dispute_and_Cryptocurrency_Transfer\"><\/span>Dowry Dispute and Cryptocurrency Transfer<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Another major issue before the court involved the deferred dowry amount of AED 10,000 mentioned in the marriage contract.<\/p>\n\n\n\n<p>The husband contended that he had already satisfied this obligation by transferring AED 47,000 to the wife for cryptocurrency investment purposes. He separately acknowledged another payment of AED 100,000 as a personal gift intended to ease tensions between the parties.<\/p>\n\n\n\n<p>However, the court rejected his argument.<\/p>\n\n\n\n<p>According to the court, the AED 47,000 transfer significantly exceeded the contractual dowry amount and lacked evidence proving it was intended as settlement of the deferred dowry obligation.
