particular person;<\/li>\n\n\n\n<li>with the intention of causing bodily injury to any person, such injury being sufficient in the ordinary course of nature to cause death;<\/li>\n\n\n\n<li>with the knowledge that the act is so eminently dangerous that it must, in all probability, cause death or such bodily injury as is likely to cause death.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" Z dies in consequence. Z dies because of the cut. One person dies because of it. A commits murder even though he had no intention of killing that person.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"exceptions-when-murder-becomes-culpable-homicide\"><span class=\"ez-toc-section\" id=\"Exceptions_When_Murder_Becomes_Culpable_Homicide_Not_Amounting_To_Murder\"><\/span>Exceptions: When Murder Becomes Culpable Homicide Not Amounting To Murder<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Section 300 also specifies certain situations when the murder is considered culpable homicide not amounting to murder.<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><th>Exception<\/th><th>Description<\/th><\/tr><\/thead><tbody><tr><td>Grave And Sudden Provocation<\/td><td>If the offender does an act that causes death because of grave and sudden provocation by the other.<\/td><\/tr><tr><td>Exceeding Right Of Private Defence<\/td><td>If the offender causes death while exceeding the right to private defence in good faith.<\/td><\/tr><tr><td>Act Of Public Servant<\/td><td>If the offender is a public servant and does an act that he, in good faith, believes to be lawful.<\/td><\/tr><tr><td>Sudden Fight<\/td><td>If the act happens in a sudden fight in the heat of passion.<\/td><\/tr><tr><td>Consent Of The Deceased<\/td><td>If the deceased is above 18 and the death is caused by his own consent.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"summary-of-section-300-ipc\"><span class=\"ez-toc-section\" id=\"Summary_Of_Section_300_IPC\"><\/span>Summary Of Section 300 IPC<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Under Section 300, culpable homicide becomes murder when the act is committed with intention, knowledge, or bodily injury sufficient to cause death. However, the law also recognises specific exceptions where the offence is treated as culpable homicide not amounting to murder.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"exceptions-to-murder\"><span class=\"ez-toc-section\" id=\"Exceptions_to_Murder\"><\/span>Exceptions to Murder<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Under criminal law, certain situations reduce the offence of murder to culpable homicide not amounting to murder. These exceptions are recognised when specific legal conditions are fulfilled.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"exception-1-culpable-homicide-not-murder\"><span class=\"ez-toc-section\" id=\"Exception_1_%E2%80%93_When_Culpable_Homicide_Is_Not_Murder\"><\/span>Exception 1 \u2013 When Culpable Homicide Is Not Murder<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>When a person is deprived of the power of self-control and causes death by such a mistake or accident, it shall not amount to murder but rather culpable homicide.<\/p>\n\n\n\n<p>However, this exception is subject to provisos, which include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>First<\/strong>\u2014There is no voluntary provocation that later on serves the purpose of an excuse for killing or doing harm.<\/li>\n\n\n\n<li><strong>Secondly.<\/strong> \u2014 Such provocation is not due to the act of a public servant, obedience to law or any other lawful exercise of the powers of such a public servant.<\/li>\n\n\n\n<li><strong>Thirdly.<\/strong> \u2014 The provocation is not given by anything done in the lawful exercise of the right of private defence.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"key-points-exception-1\"><span class=\"ez-toc-section\" id=\"Key_Points_of_Exception_1\"><\/span>Key Points of Exception 1<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><th>Requirement<\/th><th>Description<\/th><\/tr><\/thead><tbody><tr><td>Loss of Self-Control<\/td><td>The accused must have been deprived of self-control.<\/td><\/tr><tr><td>No Voluntary Provocation<\/td><td>The accused should not create provocation intentionally.<\/td><\/tr><tr><td>Lawful Acts Excluded<\/td><td>Provocation arising from lawful acts does not apply.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"exception-2-right-of-private-defence\"><span class=\"ez-toc-section\" id=\"Exception_II_%E2%80%93_Exceeding_the_Right_of_Private_Defence\"><\/span>Exception II \u2013 Exceeding the Right of Private Defence<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Exception 2 to the clause deals with those cases wherein the right of private defence of a person is exceeded. If there is an intention that can be clearly made out, the offence constitutes murder; if it is unintentional, it amounts to culpable homicide not amounting to murder.<\/p>\n\n\n\n<p>Culpable homicide will in any case not be murder if the offender exercises more than necessary force for his private defence. In such a case, if death is caused by exercising the same without any scope of time of premeditation to think about the act they are going to commit and there is no intention to do more than necessary harm, the story may be slightly different.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"essential-elements-exception-2\"><span class=\"ez-toc-section\" id=\"Essential_Elements_of_Exception_II\"><\/span>Essential Elements of Exception II<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Exercise of the right of private defence.<\/li>\n\n\n\n<li>Use of force exceeding lawful limits.<\/li>\n\n\n\n<li>No premeditation.<\/li>\n\n\n\n<li>No intention to cause more harm than necessary.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"exception-3-public-servants-exceeding-powers\"><span class=\"ez-toc-section\" id=\"Exception_III_%E2%80%93_Public_Servants_Exceeding_His_Powers\"><\/span>Exception III \u2013 Public Servants Exceeding His Powers<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>This is applicable if the public servant causes death by doing an act which he, in good faith, believes to be lawful and necessary for the due discharge of duty as such public servant; there mustn\u2019t be any ill will involved.<\/p>\n\n\n\n<p>In the case of <strong>Dukhi Singh vs State<\/strong>, the appellant, who was a constable of the RFF (Railway Protection Force) while on duty, killed a fireman unintentionally.
