By \u2018rash act\u2019 we mean any act which is done restlessly. By the term \u2018negligent act&#8217;, we mean a breach of duty due to an omission to do something which a reasonable man would do.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"essential-elements-of-negligent-act\"><span class=\"ez-toc-section\" id=\"Essential_Elements_Of_A_Negligent_Act\"><\/span>Essential Elements Of A Negligent Act<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>There are four basic elements that a person has to fulfil in order to do a negligent act. These elements are as follows:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"duty-of-care\"><span class=\"ez-toc-section\" id=\"Duty\"><\/span>Duty<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>For committing a negligent act, there must be some duty on the part of the defendant. Here it is important to understand whether the defendant has taken legal duty of care towards the plaintiff.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"breach-of-duty\"><span class=\"ez-toc-section\" id=\"Breach_Of_Duty\"><\/span>Breach Of Duty<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>After fulfilling the first criteria, the plaintiff must prove that the defendant has breached the legal duty imposed on him\/her. It talks about the breach of duty on the part of the defendant, which he\/she is expected to do, as he\/she has some legal duty towards the plaintiff.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"action-causing-damage\"><span class=\"ez-toc-section\" id=\"The_Action_Of_Causing_Something\"><\/span>The Action Of Causing Something<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>It means that the damage caused to the plaintiff is due to the act of the defendant. Here the defendant may do an act which is not expected from him\/her, or the defendant may be negligent in not doing an act which was expected from him\/her.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"damages-and-injury\"><span class=\"ez-toc-section\" id=\"Damages\"><\/span>Damages<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>At last, what matters is there must be some damage\/injury that is caused to the plaintiff, and this damage should be the direct consequence of the defendant\u2019s act.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"facts-required-to-invoke-section-304a\"><span class=\"ez-toc-section\" id=\"Facts_Required_To_Invoke_Section_304A\"><\/span>Facts Required To Invoke Section 304A<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Thus, it&#8217;s clear that the facts which must be proved in order to invoke the applicability of this section are essentially threefold:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Death of a human being;<\/li>\n\n\n\n<li>The accused caused the death;<\/li>\n\n\n\n<li>The death was caused by the doing of a rash and negligent act, though it did not amount to culpable homicide.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"difference-between-criminal-rashness-and-negligence\"><span class=\"ez-toc-section\" id=\"Difference_Between_Criminal_Rashness_And_Criminal_Negligence\"><\/span>Difference Between Criminal Rashness And Criminal Negligence<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><th>Concept<\/th><th>Explanation<\/th><\/tr><\/thead><tbody><tr><td>Criminal Rashness<\/td><td>Criminal rashness is hazarding a dangerous or wanton act with the knowledge that it is so and that it may cause injury, or with knowledge that injury will probably be caused.<\/td><\/tr><tr><td>Criminal Negligence<\/td><td>Criminal negligence is acting without the consciousness that the illegal and mischievous effect will follow but in circumstances which show that the actor has not exercised the caution incumbent upon him and that if he had, he would have had the consciousness.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"rash-or-negligent-act-under-section-304a\"><span class=\"ez-toc-section\" id=\"Rash_Or_Negligent_Act_Under_Section_304A\"><\/span>Rash Or Negligent Act Under Section 304A<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The rash or negligent act which is declared to be a crime is one not amounting to culpable homicide, and it must therefore be taken that intentionally or knowingly inflicted violence, directly and wilfully caused, is excluded.<\/li>\n\n\n\n<li>The &#8216;rash or negligent act&#8217; referred to in this section means the act which is the immediate cause of death and not any act or omission which can at most be said to be a remote cause of death.<\/li>\n\n\n\n<li>If an act is intended to hurt and injure a specific person or object, the perpetrator of the act must be imputed with an intentional act done with consideration and cannot amount to a &#8216;rash&#8217; and &#8216;negligent&#8217; act.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"difference-between-rashness-and-negligence\"><span class=\"ez-toc-section\" id=\"Difference_Between_Rashness_And_Negligence\"><\/span>Difference Between Rashness And Negligence<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>It is imperative to note that there is a difference between rashness and negligence.<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><th>Rashness<\/th><th>Negligence<\/th><\/tr><\/thead><tbody><tr><td>A rash act is primarily an overhasty act.<\/td><td>Negligence is a breach of duty caused by an omission to do something which a reasonable person, guided by those considerations which ordinarily regulate the conduct of human affairs, would do.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"cherubin-gregory-v-state-of-bihar-1964\"><span class=\"ez-toc-section\" id=\"Cherubin_Gregory_v_State_of_Bihar_1964\"><\/span>Cherubin Gregory v. State of Bihar (1964)<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The definition of a rash or negligent act can be understood through the famous case of <em>Cherubin Gregory v. State of Bihar<\/em>. In this case, the Supreme Court explained the distinction between rash and negligent acts.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"facts-of-the-case\"><span class=\"ez-toc-section\" id=\"Facts_of_the_Case\"><\/span>Facts of the Case<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>In this case, the appellant was charged under Section 304A of the Indian Penal Code (IPC) for causing the death of a woman who stayed near the house of the appellant.<\/p>\n\n\n\n<p>The deceased had been using the latrine\/toilet of the accused for about a week. The accused gave oral warnings to the deceased regarding the use of his latrine, but the deceased continued to use it.<\/p>\n\n\n\n<p>As the accused found his oral warnings insufficient, he placed a naked copper wire carrying electricity on the passage leading to the latrine.<\/p>\n\n\n\n<p>On the day of the incident, the woman went to the latrine of the appellant.
