Culpable Homicide<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The word &#8216;HOMICIDE&#8217; is derived from &#8216;homo&#8217; and &#8216;cide&#8217;. &#8216;Homo&#8217; means &#8216;human&#8217;, and &#8216;cide&#8217; means &#8216;killing by a human&#8217;. &#8216;Homicide&#8217; means the killing of a human being by another human being. It is the highest degree of the bodily injury that can be inflicted on a human body. In every case of homicide, one who causes the death of another is not culpable. &#8216;Culpable&#8217; means blameworthy or guilty.<\/p>\n\n\n\n<p>For example: Death caused by self-defence, by reason of mistake, by bonafide execution of law, etc. Likewise, if death is caused without any criminal intent or by accident or misfortune, the man will be absolved from criminal liability. On the other hand, if the killing is not justified either by law or by facts, the accused will be prosecuted and punished under law. Hence, homicide may be lawful or unlawful.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"key-features-of-culpable-homicide\"><span class=\"ez-toc-section\" id=\"Key_Features_of_Culpable_Homicide\"><\/span>Key Features of Culpable Homicide<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Killing of a human being by another human being.<\/li>\n\n\n\n<li>May be lawful or unlawful.<\/li>\n\n\n\n<li>Requires intention or knowledge in unlawful cases.<\/li>\n\n\n\n<li>Includes exceptions such as self-defence and accidents.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"murder\"><span class=\"ez-toc-section\" id=\"B_Murder\"><\/span>B. Murder<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Subject to certain exceptions, culpable homicide or murder is the act by which the death is caused. Murder is done with the intention of causing death. With the intention of causing such bodily injury as the offender knows to be likely to cause the death of the person to whom the harm is caused.<\/p>\n\n\n\n<p>With the knowledge that the act is so eminently dangerous that it must, in all probability, cause death or such bodily injury as is likely to cause death.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"essential-elements-of-murder\"><span class=\"ez-toc-section\" id=\"Essential_Elements_of_Murder\"><\/span>Essential Elements of Murder<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Intention to cause death.<\/li>\n\n\n\n<li>Intention to cause bodily injury likely to cause death.<\/li>\n\n\n\n<li>Knowledge that the act is dangerous and may cause death.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"culpable-homicide-by-causing-death-of-person\"><span class=\"ez-toc-section\" id=\"C_Culpable_Homicide_By_Causing_The_Death_Of_The_Person\"><\/span>C. Culpable Homicide By Causing The Death Of The Person<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The section says that if a person, by doing anything which he intends or knows to be likely to cause death, commits culpable homicide by causing the death of any person whose death he neither intends nor knows himself to be likely to cause, the culpable homicide committed by the offender is of the description of which it would have been if he had caused the death of the person whose death he intended or knew himself to be likely to cause.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"illustrations-of-culpable-homicide\"><span class=\"ez-toc-section\" id=\"Illustrations\"><\/span>Illustrations<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ol class=\"wp-block-list\">\n<li>A shoots B but mistakenly kills C. A can only be held liable when C is a human being.<\/li>\n\n\n\n<li>A shoots B [a dog] but misses and kills C [a human being]. He will not be held liable because mens rea was there to kill a dog.<\/li>\n<\/ol>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"punishment-for-murder\"><span class=\"ez-toc-section\" id=\"D_Punishment_For_Murder\"><\/span>D. Punishment For Murder<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Whoever commits murder shall be punished with death or imprisonment and shall also be liable to a fine. Punishment Of Murder By A Life Convict<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>A life convict is a person who is found guilty of a crime and sentenced to life imprisonment by the court. Section 303 provides that if any person commits murder and is sentenced to life imprisonment, they shall be punishable by death. Abetment Of Suicide Of Child Or Insane Person<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Abetment of suicide of a child or an insane person is dealt with in section 305 of the INDIAN PENAL CODE, 1860. Attempt To Murder<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Section 307 deals with the provisions relating to the attempt to murder. Punishment for this offence is 10 years and a fine. It is a cognisable offence. It is non-bailable too. An attempt to murder is a failed attempt to cause the death of the victim.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"features-of-attempt-to-murder\"><span class=\"ez-toc-section\" id=\"Features_Of_Attempt_To_Murder\"><\/span>Features Of Attempt To Murder<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Governed under Section 307 IPC.<\/li>\n\n\n\n<li>Cognisable offence.<\/li>\n\n\n\n<li>Non-bailable offence.<\/li>\n\n\n\n<li>Punishable with imprisonment and fine.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"attempt-to-commit-culpable-homicide\"><span class=\"ez-toc-section\" id=\"J_Attempt_To_Commit_Culpable_Homicide\"><\/span>J. Attempt To Commit Culpable Homicide<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The attempt to commit culpable homicide is covered in section 308. According to this section, whoever does any act with such intention or knowledge and under such circumstances that, if he causes death by the act, he would be guilty of culpable homicide, not amounting to murder. He shall be punished with imprisonment of either description for a term which may extend to three years or with a fine or with both.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"attempt-to-commit-suicide\"><span class=\"ez-toc-section\" id=\"K_Attempt_To_Commit_Suicide\"><\/span>K. It is punishable under section 309 of IPC. Whoever attempts to commit suicide and does any act towards the commission of such an offence shall be punished with simple imprisonment for a term which may extend to one year or with a fine or both.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"thug\"><span class=\"ez-toc-section\" id=\"L_Thug\"><\/span>L.
