Following his death, his father lodged an FIR alleging that the deceased\u2019s wife and her family members were responsible for mentally harassing him and driving him to suicide. A suicide note reportedly mentioned their names.<\/p>\n\n\n\n<p>However, while examining the facts, the High Court observed that ordinary marital discord, emotional pain, strained relationships, or humiliation arising from a failed marriage cannot automatically amount to abetment of suicide under criminal law. The Bench emphasised that criminal prosecution requires proof of a deliberate and active role that directly pushed the victim toward suicide.<\/p>\n\n\n\n<p>Justice Dr Ajoy Kumar Mukherjee noted that the couple had been living separately for months before the incident, and there was no evidence of any immediate provocation, coercion, or threatening conduct shortly before the suicide.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"mere-emotional-breakdown-is-not-instigation\"><span class=\"ez-toc-section\" class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Referring to the landmark Supreme Court judgement in <em>Ramesh Kumar vs State of Chhattisgarh<\/em>, the Court reiterated that \u201cinstigation\u201d under Section 107 IPC requires active encouragement, provocation, or incitement.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201cA word uttered in anger or emotional frustration, without intending the actual consequences, cannot by itself amount to instigation.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p>The court also relied upon the Supreme Court ruling in <em>State of West Bengal vs Orilal Jaiswal<\/em>, where it was held that emotional sensitivity, marital stress, or domestic disagreements alone are insufficient to establish criminal abetment of suicide.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" social embarrassment, there was no material showing that the accused persons created circumstances leaving him with no option except suicide.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201cThere needs to be a positive act that creates an environment where the deceased is pushed to the edge.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p>Since no such proximate act or intentional conduct was established, the Court quashed the criminal proceedings pending before the Sessions Court at
