Sanhita (BNS), a provision dealing with allegations of sexual intercourse obtained through deceit, including alleged false promises of marriage.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"court-observations-on-consensual-relationship\"><span class=\"ez-toc-section\" id=\"Court_Observes_Relationship_Was_Between_%E2%80%9CTwo_Mature_Adults%E2%80%9D\"><\/span>Court Observes Relationship Was Between \u201cTwo Mature Adults\u201d<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>While hearing the bail plea, Additional Sessions Judge Syed Zishan Ali Warsi noted that the facts presented before the court suggested a consensual relationship rather than a coercive or deceptive one.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201cPrima facie, it appears to be a case of a consensual relationship between two mature and adult persons.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p>This observation became central to the decision to grant bail to the accused.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"how-the-relationship-began\"><span class=\"ez-toc-section\" id=\"How_The_Relationship_Began\"><\/span>How The Relationship Began<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>According to the FIR, the complainant, a 36-year-old woman, came into contact with the accused in May 2025 through the matrimonial platform Shaadi.com.<\/p>\n\n\n\n<p>The two reportedly communicated regularly over WhatsApp and discussed several personal and matrimonial issues, including:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Family background<\/li>\n\n\n\n<li>Marriage expectations<\/li>\n\n\n\n<li>Caste compatibility<\/li>\n\n\n\n<li>Future plans<\/li>\n<\/ul>\n\n\n\n<p>The accused allegedly claimed that he was working in Prague after completing his PhD, which, according to the complainant, created an impression that he intended to marry her.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"allegations-in-the-fir\"><span class=\"ez-toc-section\" id=\"Allegations_In_The_FIR\"><\/span>Allegations In The FIR<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The prosecution alleged that the accused and the complainant met at a hotel in Mahipalpur on 26 December 2025, where physical relations took place. The complainant claimed that consent for the relationship was given on the assurance of marriage.<\/p>\n\n\n\n<p>Later, after the accused allegedly stopped communicating and married another woman, the complainant filed an FIR accusing him of sexual exploitation through a false promise of marriage.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"defence-relied-on-womans-statement\"><span class=\"ez-toc-section\" id=\"Defence_Relied_On_Womans_Own_Statement\"><\/span>Defence Relied On Woman\u2019s Own Statement<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>During the bail hearing, the defence argued that the complainant was a well-educated adult capable of understanding the nature and consequences of the relationship.<\/p>\n\n\n\n<p>A major turning point in the case was the complainant\u2019s own statement recorded under Section 183 of the Bharatiya Nagarik Suraksha Sanhita (BNSS). In that statement, she reportedly admitted that there were the following:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201cNo commitment of marriage, but only daily communication.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p>She also acknowledged that the physical relationship had developed \u201cwith consent&#8221;.<\/p>\n\n\n\n<p>The defence contended that these admissions weakened the allegation that consent had been obtained through deception.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"prosecution-opposed-bail\"><span class=\"ez-toc-section\" id=\"Prosecution_Opposed_Bail\"><\/span>Prosecution Opposed Bail<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The prosecution opposed the bail plea and argued that the allegations against the accused were serious in nature. It was also argued that the complainant\u2019s earlier statement may have been influenced by emotional stress.<\/p>\n\n\n\n<p>However, the court noted several important circumstances in favour of the accused.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"court-notes-no-need-for-police-custody\"><span class=\"ez-toc-section\" id=\"Court_Notes_No_Need_For_Police_Custody\"><\/span>Court Notes: No sought police custody of the accused during the investigation.<\/p>\n\n\n\n<p>The court further observed that the FIR itself referred to only one instance of physical relations between the parties.<\/p>\n\n\n\n<p>Importantly, the prosecutrix also stated before the magistrate that:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201cThe applicant has not made any commitment for marriage with the prosecutrix.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p>She further admitted that she filed the complaint after learning about the accused\u2019s marriage because she had become emotionally attached to him.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"bail-granted-with-conditions\"><span class=\"ez-toc-section\" id=\"Bail_Granted_With_Conditions\"><\/span>Bail Granted With Conditions<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>While granting regular bail, the court held:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201cNo fruitful purpose will be served by keeping the applicant behind bars for an indefinite period.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p>The court emphasised that continued incarceration was unnecessary, especially when the investigation did not require custodial interrogation.<\/p>\n\n\n\n<p>The accused was granted bail subject to conditions, including:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Surrendering his passport<\/li>\n\n\n\n<li>Cooperating with
