It is prepared by a qualified forensic doctor after examining the body and detailing the cause of death, injuries, and other vital medical findings.<\/p>\n<p>But how does a medical report transform into valid, admissible evidence in a courtroom?<\/p>\n<p><strong>What is a Post-Mortem Report?<\/strong><\/p>\n<p>A post-mortem report is a scientific record prepared by the medical officer who conducts the autopsy. It contains objective clinical observations, including:<\/p>\n<ul>\n<li><strong>External Examination:<\/strong> Injuries, bruises, ligatures, and marks on the body.<\/li>\n<li><strong>Internal Examination:<\/strong> The state of internal organs, fractures, and internal bleeding.<\/li>\n<li><strong>Pathological Findings:<\/strong> Signs of disease, poisoning, asphyxia, or physical violence.<\/li>\n<li><strong>Expert Opinion:<\/strong> The doctor\u2019s professional conclusion regarding the cause, manner, and approximate time of death.<\/li>\n<\/ul>\n<p>On its own, this report is a medical document. For it to be accepted as legal proof, it must be admitted and proved according to the rules of evidence.<\/p>\n<p><strong>How is it proved in court?<\/strong><\/p>\n<ol>\n<li><strong> The Doctor\u2019s Testimony<\/strong><\/li>\n<\/ol>\n<p>As a rule, a document cannot speak for itself; its author must speak for it. The doctor who conducted the autopsy must appear in court as an expert witness to prove the report. The doctor:<\/p>\n<ul>\n<li>Formally identifies the report and confirms their signature.<\/li>\n<li>Translates complex medical jargon into plain language for the judge and prosecutors.<\/li>\n<li>Refreshes their memory using the report while testifying.<\/li>\n<\/ul>\n<ol start=\"2\">\n<li><strong> Cross-Examination<\/strong><\/li>\n<\/ol>\n<p>Once the prosecution examines the doctor, the defence lawyers cross-examine them. This step tests the accuracy and reliability of the medical opinion by probing the following:<\/p>\n<ul>\n<li>Whether the injuries could have been caused by means other than the alleged weapon.<\/li>\n<li>Whether the time of death aligns with the prosecution&#8217;s timeline.<\/li>\n<li>Any potential gaps or inconsistencies in the autopsy protocol.<\/li>\n<\/ul>\n<ol start=\"3\">\n<li><strong> Linking with Corroborative Evidence<\/strong><\/li>\n<\/ol>\n<p>A post-mortem report is an opinion; it is rarely viewed in isolation. He has attended Indian government sponsored specialized training in police and management matters in SVPNPA, Hyderabad, IIM, Ahmedabad and Singapore. He is the author of the books 'Police Investigation &amp; Allied Matters' and 'Alternative Dispute Resolution: Evolving Trends and Innovations' demonstrating his commitment to knowledge sharing within the law enforcement field.
