At the heart of the legal battle was a fundamental question:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">Can a father reduce maintenance obligations by arguing that the mother and child spent time in a lower-cost foreign country?<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">The answer from the UAE\u2019s highest civil court was clear \u2014 no.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Background_of_the_Dispute\"><\/span>Background of the Dispute<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The couple, married under Islamic law, had a young daughter and were residing in Dubai. According to the wife, the marriage was marred by repeated verbal and physical abuse. She referred to prior police complaints, which she had withdrawn earlier in an attempt to preserve the marriage and family stability.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The dispute escalated in October 2024, when the wife left the marital residence with the child and returned to Egypt. The husband accused her of unlawfully leaving the matrimonial home without permission and alleged that she had effectively abducted the child. He argued that this act amounted to &#8220;nushuz&#8221; or disobedience under Islamic family law principles and sought cancellation of her maintenance rights.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The wife, however, maintained that she had informed her husband before leaving and asserted that her departure was compelled by the husband\u2019s failure to provide a safe and independent residence for her and the child, particularly away from tensions involving children from his previous marriages.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">By October 2025, the wife and child returned to the UAE with the intention of rebuilding their lives in Dubai. This return significantly altered the legal dynamics of the case because the courts now had to assess the child\u2019s needs based on the realities of living in Dubai \u2014 one of the world\u2019s most expensive cities.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Proceedings_Before_the_Dubai_Court_of_First_Instance\"><\/span>Proceedings Before the Dubai Court of First Instance<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The legal proceedings began in June 2025 before the Dubai Court of First Instance. The husband sought a declaration that the wife was disobedient and requested removal of her custody and maintenance rights. The wife filed counterclaims demanding spousal support, child maintenance, housing expenses, and other family-related costs.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court of First Instance focused heavily on the physical act of leaving the marital home. It held that the wife had technically abandoned the matrimonial residence without sufficient legal justification because she travelled abroad with the child without documented consent from the husband.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Key_Findings_of_the_Court_of_First_Instance\"><\/span>Key Findings of the Court of First Instance<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The wife was declared disobedient.<\/li>\n\n\n\n<li>Her personal alimony rights were revoked from October 2024 onwards.<\/li>\n\n\n\n<li>The child\u2019s right to support was preserved.<\/li>\n\n\n\n<li>The husband was ordered to pay modest child maintenance and housing support.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Importantly, the court clarified that a finding of marital disobedience against the mother does not automatically make her an unfit custodian for a young child. The child remained in her custody.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Dubai_Court_of_Appeal_Reconsiders_%E2%80%9CDisobedience%E2%80%9D\"><\/span>Dubai Court of Appeal Reconsiders \u201cDisobedience\u201d<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Both parties challenged the ruling before the Dubai Court of Appeal. By this stage, the wife and child had already returned to Dubai, making the practical realities of UAE life central to the dispute.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court of Appeal adopted a more balanced interpretation of the wife\u2019s departure. It held that her actions could not automatically be characterised as &#8220;nushuz&#8221; because the husband had allegedly failed to provide suitable and independent accommodation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In other words, leaving an unsafe or unsuitable home environment may constitute a legitimate legal excuse.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"wp-block-paragraph\">However, the court still maintained relatively low maintenance figures because it reasoned that the mother and child had spent considerable time in Egypt, where living using Egyptian economic standards while the child was physically living in Dubai.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court relied heavily on the UAE\u2019s modern family law framework under the following:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Federal Decree-Law No. 41 of 2024<\/li>\n\n\n\n<li>Relevant provisions governing child maintenance, residency, guardianship, and custodial rights<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The court emphasised that maintenance must provide a \u201cdignified standard of living\u201d according to the economic realities of the place where the child resides.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Since the child was residing in Dubai, UAE, living costs \u2014 not Egyptian costs \u2014 had to be considered.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court found the previously awarded amounts grossly inadequate for Dubai standards and ordered the lower court to reassess the maintenance figures.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Residency_Visas_and_Health_Insurance_Are_Legal_Necessities\"><\/span>Residency Visas and Health Insurance Are medical insurance.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The wife argued that without residency sponsorship and health insurance, both she and the child faced legal uncertainty and serious medical vulnerability in the UAE.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court of Cassation agreed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Referring to Articles 116 and 117 of the 2024 Personal Status Law, the court ruled that the father\u2019s obligations extend beyond food and shelter.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" significant evolution in UAE family law because earlier disputes often treated visa sponsorship as a separate immigration issue rather than part of maintenance obligations.<\/p>\n\n\n\n<h2 insufficient documentary evidence proving the husband possessed extraordinary wealth capable of justifying such expenses.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court clarified an important
