The law places great importance on a person\u2019s right to possess and peacefully enjoy their land. Here is a straightforward breakdown of how trespass works, what makes it illegal, how a defendant can fight it, and what solutions are available to the property owner.<\/p>\n<p><strong>What is Trespass to Immovable Property?<\/strong><\/p>\n<p>Trespass is the unjustifiable, direct interference with someone else&#8217;s land. It is primarily a tort\u2014a civil wrong for which a person may sue for damages. However, trespass may also amount to criminal trespass when entry is made with intent to commit an offence, intimidate, insult, or annoy the person in possession.<\/p>\n<p><strong>Types of Trespass<\/strong><\/p>\n<p>Trespass does not merely involve physically stepping onto another person\u2019s land. In law, it can arise in several different forms: Legally, it can happen in five distinct ways:<\/p>\n<ul>\n<li><strong>Trespass by Entry:<\/strong> The most common form. This is physically walking, driving, or entering onto someone else&#8217;s land without their permission.<\/li>\n<li><strong>Trespass by Remaining:<\/strong> This happens when someone enters your land legally (like a houseguest or a repairman) but <strong>refuses to leave<\/strong> after you ask them to go, or after their permission expires.<\/li>\n<li><strong>Trespass by Placing Objects:<\/strong> Throwing trash into a neighbour&#8217;s yard, parking a car on their driveway, or allowing a structure (like a fence) to hang over their property line constitutes trespass by placing physical objects.<\/li>\n<li><strong>Trespass by Animal: <\/strong>This occurs when livestock (like cattle or sheep) strays onto another person&#8217;s land. The animal&#8217;s owner is held strictly liable for any resulting damage to crops or property, without proof of negligence. However, ordinary domestic pets like cats and dogs are generally exempt.<\/li>\n<li><strong>Trespass by Air: <\/strong>This involves unauthorized intrusion into the lower airspace reasonably necessary for the ordinary use and enjoyment of land.
