High Court has the power to quash the FIR and remove the accused husband\u2019s name from the proceedings. Recent Supreme Court judgements in 2024, 2025, and 2026 have once again emphasised that criminal law cannot be allowed to become a weapon of harassment in matrimonial conflicts.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_Is_Section_498A_IPC\"><\/span>What Is Section 498A IPC?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Section 498A of the Indian Penal Code deals with cruelty by the husband or his relatives toward a married woman. The provision was introduced to combat genuine cases of dowry harassment and domestic cruelty. It provides punishment of up to three years imprisonment along with a fine.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Under the newly implemented criminal laws in India:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Section 498A IPC has now been replaced by Section 85 of the Bharatiya Nyaya Sanhita (BNS)<\/li>\n\n\n\n<li>The definition of cruelty is contained in Section 86 BNS<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">However, older FIRs registered before the implementation of the new laws may still continue under Section 498A IPC depending on the date of the alleged offence.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Can_a_Husband_Remove_His_Name_From_a_498A_FIR\"><\/span>Can a Husband Remove His Name From a 498A FIR?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Yes. An innocent husband can seek removal of his name from a false 498A FIR, but this cannot usually be done simply by requesting the police. In practice, the legal remedy is generally pursued before the High Court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The most common remedies include:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"1_High_Court_Quashing_Petition\"><\/span>1. High Court Quashing Petition<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The accused may file the following:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A petition under Section 482 CrPC in older cases<\/li>\n\n\n\n<li>A petition under Section 528 BNSS under the new criminal procedure law<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The High Court uses its inherent powers to prevent abuse of legal process and to secure justice.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"2_Writ_Petition_Under_Article_226\"><\/span>2. Settlement-Based Quashing<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">If the husband and wife settle the matrimonial dispute amicably, the High Court may quash criminal proceedings in the interest of justice.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Latest_Supreme_Court_View_on_Misuse_of_498A\"><\/span>Latest Supreme Court View on Misuse of 498A<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Over the years, the Supreme Court of India has repeatedly expressed concern about the misuse of Section 498A in matrimonial disputes.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"2024_Supreme_Court_Observations\"><\/span>2024 Supreme Court Observations<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">In a significant 2024 judgement, the Supreme Court observed that vague and generalised allegations against husbands and family members should not automatically result in criminal prosecution. The Court warned that criminal law cannot be used as an instrument of personal vendetta or arm-twisting during marital disputes.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"2025_Supreme_Court_Judgment\"><\/span>2025 Supreme Court Judgment<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">In another important 2025 ruling, the Supreme Court quashed a 498A FIR and charge sheet after finding that the criminal case appeared to have been filed as retaliation after the husband initiated divorce proceedings.
