This means that:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A husband cannot file a domestic violence complaint as a victim.<\/li>\n\n\n\n<li>An elderly father allegedly abused by family members cannot seek relief under the DV Act.<\/li>\n\n\n\n<li>Male partners facing emotional, financial, or physical abuse remain outside the Act\u2019s protection.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The law recognises several forms of abuse, including:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Physical violence<\/li>\n\n\n\n<li>Emotional abuse<\/li>\n\n\n\n<li>Verbal abuse<\/li>\n\n\n\n<li>Sexual abuse<\/li>\n\n\n\n<li>Economic abuse<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Yet, despite acknowledging that domestic violence can take many forms, the legal remedy itself remains gender-specific.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 id=\"h-the-supreme-court-s-important-shift-in-hiral-p-harsora-case\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Supreme_Courts_Important_Shift_in_Hiral_P_Harsora_Case\"><\/span>The Supreme Court\u2019s Important Shift in Hiral P. Harsora Case<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A major constitutional development came in <strong>Hiral P. Harsora v. Kusum Narottamdas Harsora<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court struck down the words \u201cadult male\u201d from Section 2(q) of the DV Act, ruling that restricting respondents only to adult men violated Article 14 of the Constitution.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This judgement created an important legal shift:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Women can now also be respondents in domestic violence cases.<\/li>\n\n\n\n<li>Mothers-in-law, sisters-in-law, and female relatives may face proceedings under the DV Act.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">However, the Court stopped short of making the complainant category gender-neutral. The law still recognises only women as victims under the Act.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This has created what many legal scholars describe as a \u201chalfway reform&#8221; \u2013 where liability became gender-neutral, but protection did not.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 id=\"h-growing-debate-around-male-victims-of-domestic-violence\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Growing_Debate_Around_Male_Victims_of_Domestic_Violence\"><\/span>Growing Debate Around Male Victims of Domestic Violence<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">In recent years, public discussions around domestic violence against men have intensified across India.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Family courts and matrimonial disputes increasingly involve allegations of the following:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Emotional manipulation<\/li>\n\n\n\n<li>Financial exploitation<\/li>\n\n\n\n<li>Mental cruelty<\/li>\n\n\n\n<li>False criminal complaints<\/li>\n\n\n\n<li>Parental alienation<\/li>\n\n\n\n<li>Elder abuse within households<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Critics argue that although women continue to face serious domestic violence concerns, the law should also recognise genuine male victims and senior citizens facing abuse inside the home.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Many lawyers point out a practical courtroom reality: men facing abuse often struggle to obtain legal protection because there is no dedicated domestic violence mechanism available to them.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 id=\"h-supreme-court-observations-on-misuse-of-matrimonial-laws\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Supreme_Court_Observations_on_Misuse_of_Matrimonial_Laws\"><\/span>Supreme Court Observations on Misuse of Matrimonial Laws<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The judiciary has repeatedly acknowledged concerns regarding misuse of certain matrimonial provisions.<\/p>\n\n\n\n<h3 id=\"h-preeti-gupta-v-state-of-jharkhand\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Preeti_Gupta_v_State_of_Jharkhand\"><\/span>Preeti Gupta v. State of Jharkhand<\/strong>, the Supreme Court observed that exaggerated allegations in matrimonial disputes sometimes result in the unnecessary implication of family members.<\/p>\n\n\n\n<h3 id=\"h-rajesh-sharma-v-state-of-u-p\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Rajesh_Sharma_v_State_of_UP\"><\/span>Rajesh Sharma v. State of U.P.<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">In <strong>Rajesh Sharma v.
