Active euthanasia involves the use of a hazardous substance or lethal method to end a person&#8217;s life. Passive euthanasia involves stopping medical treatment, in the absence of which a person is likely to die.<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><th>Type<\/th><th>Description<\/th><\/tr><\/thead><tbody><tr><td>Active Euthanasia<\/td><td>Involves the use of a hazardous substance or lethal method to end a person&#8217;s life.<\/td><\/tr><tr><td>Passive Euthanasia<\/td><td>Involves stopping medical treatment, in the absence of which a person is likely to die.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">Both active and passive euthanasia can be voluntary or involuntary.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Voluntary Euthanasia:<\/strong> When the consent of the patient is taken, it is voluntary.<\/li>\n\n\n\n<li><strong>Involuntary Euthanasia:<\/strong> When the patient is not in a condition to give consent and the decision is taken by another person on their behalf, it is involuntary.<\/li>\n<\/ul>\n\n\n\n<h2 id=\"h-constitutional-framework-and-the-right-to-die\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Constitutional_Framework_and_the_Right_to_Die\"><\/span>Constitutional Framework and the Right to Die<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Constitution of India explicitly provides for the right to life for all its subjects. It is a fundamental right guaranteed under Article 21, and there are no doubts when it comes to the right to life itself. However, questions have persistently arisen whenever the right to die is discussed \u2014 it has always been a matter of contention for lawmakers and courts alike. The courts, in various judgements, have interpreted this right differently and based their opinions accordingly.<\/p>\n\n\n\n<h3 id=\"h-state-of-maharashtra-v-maruti-sripati-dubal\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"State_of_Maharashtra_v_Maruti_Sripati_Dubal\"><\/span>State of Maharashtra v. Maruti Sripati Dubal<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The Bombay High Court, in <em>State of Maharashtra v. Maruti Sripati Dubal<\/em> (1987 Cr LJ 743), held that the right to life under Article 21 also includes the right to die. It was contended that Section 309 of the Indian Penal Code, which criminalised attempting to commit suicide, was unconstitutional as it violated Article 21. The court clearly stated in this judgement that the right to die is just uncommon, not unnatural.<\/p>\n\n\n\n<h3 id=\"h-p-rathinam-v-union-of-india\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"P_Rathinam_v_Union_of_India\"><\/span>P. Rathinam v. Union of India<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Subsequently, in <em>P. Rathinam v. Union of India<\/em> (1994) 3 SCC 394, the Supreme Court of India also accepted that the right to live under Article 21 includes the right not to live. It is pertinent to note that this case dealt primarily with suicide and Section 309 IPC, not with euthanasia directly. However, its observations on personal autonomy laid the groundwork for future euthanasia jurisprudence.<\/p>\n\n\n\n<h3 id=\"h-gian-kaur-v-state-of-punjab\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Gian_Kaur_v_State_of_Punjab\"><\/span>Gian Kaur v. State of Punjab<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">This position was reversed in <em>Gian Kaur v. State of Punjab<\/em> (AIR 1996 SC 1257), in which the Supreme Court overruled the <em>P. Rathinam<\/em> judgement and held that the Right to Life under Article 21 does not include the Right to Die.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At the same time, the Court made a crucial distinction: while a person has no right to die, the right to life includes the right to live with human dignity \u2014 and therefore, the right to die with dignity.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court held that the right to die with dignity must be distinguished from the right to die. The right to die is an unnatural death that cuts short a person&#8217;s natural lifespan; the right to die with dignity, on the other hand, is a humane provision for a person in a condition such as a Permanent Vegetative State (PVS) to be relieved of prolonged suffering.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Hence, both rights are altogether different and must not be misconstrued.<\/p>\n\n\n\n<h3 id=\"h-key-judicial-principles-on-the-right-to-die\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Key_Judicial_Principles_on_the_Right_to_Die\"><\/span>Key Judicial Principles on the Right to Die<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The Right to Life is guaranteed under Article 21 of the Constitution of India.<\/li>\n\n\n\n<li>The Bombay High Court initially interpreted Article 21 as including the right to die.<\/li>\n\n\n\n<li>The Supreme Court in <em>P. Union of India (2026) \u2014 Passive Euthanasia Becomes Reality<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The most significant and recent development in this area of law is <strong>Harish Rana v. Union of India (2026 INSC 222)<\/strong>, decided on 11 March 2026 by a bench of Justice J.B. Pardiwala and Justice K.V. Viswanathan.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Harish Rana was a 19-year-old student in Chandigarh when he fell from the fourth floor of a building in August 2013, sustaining catastrophic brain injuries that left him in a permanent vegetative state with 100% quadriplegia for over thirteen years.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court permitted the withdrawal of Clinically Assisted Nutrition and Hydration (CANH) being administered through a PEG tube. The court unequivocally held that CANH administered through a feeding tube constitutes medical treatment \u2014 not merely basic care \u2014 and can therefore be lawfully withdrawn when its continuation no longer serves the patient&#8217;s best interests. We can only begin to imagine, then, the suffering of those who have lived in a vegetative state for over a decade, dependent entirely on machines and tubes for survival. Who are we, as a majority, to speak of sanctity and ethics in the face of that suffering?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I believe that passive euthanasia must remain a deeply personal decision. Every individual is different, and people suffering from incurable and terminal conditions must have the right to decide what happens to their own bodies. Respecting a person&#8217;s decision to choose death over prolonged, medically futile suffering is not cruelty \u2014 it is the highest form of compassion.
