sufficient connection for a Delhi court to hear a trademark and passing-off case, even if the plaintiff operates from another state.<\/p>\n\n\n\n<h2 id=\"h-factual-and-procedural-background\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Factual_And_Procedural_Background\"><\/span>Factual And Procedural Background<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Ravinder Singh, trading as Royal International from Amritsar, Punjab, filed a suit in the Delhi High Court seeking a permanent injunction against Regoshin Healthcare Pvt Ltd and others.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He alleged that the defendants were infringing his \u201cRoyal\u201d trademarks and trade dress by selling similar marks on dietary supplements and pharmaceutical products.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Defendants No. 1 and 3 moved an application under Order VII Rule 10 of the Code of Civil Procedure, requesting the plaint be returned for lack of territorial jurisdiction.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">They argued that:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The plaintiff neither resides nor carries on business in Delhi.<\/li>\n\n\n\n<li>The plaintiff has no drug licence for sales in Delhi.<\/li>\n\n\n\n<li>The defendants\u2019 websites are merely passive in necessary licences.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The plaintiff countered that the<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The defendants\u2019 registered office is located in Delhi.<\/li>\n\n\n\n<li>The defendants\u2019 website contains a functional \u201cContact Us\u201d page accessible in Delhi.<\/li>\n\n\n\n<li>The defendants\u2019 products are listed on popular platforms like IndiaMart and Justdial.<\/li>\n\n\n\n<li>These online listings are accessible across India, including Delhi.<\/li>\n<\/ul>\n\n\n\n<h3 id=\"h-key-jurisdictional-contentions\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Key_Jurisdictional_Contentions\"><\/span>Key Jurisdictional Contentions<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><th>Party<\/th><th>Main Argument<\/th><\/tr><\/thead><tbody><tr><td>Plaintiff<\/td><td>The Delhi court has jurisdiction due to the when deciding an application for return of plaint under Order VII Rule 10 CPC, the court must follow the principle of \u201cdemurrer\u201d. This means the court accepts all averments in the plaint as true and does not look into the defendant\u2019s defence at this preliminary stage.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The judge referred to the Supreme Court\u2019s decision in <strong>Exphar SA v. Eupharma Laboratories Ltd. (2004) 3 SCC 688<\/strong>, which laid down that jurisdiction objections at this stage must be tested only on the basis of facts pleaded in the plaint.<\/p>\n\n\n\n<h3 id=\"h-territorial-jurisdiction-under-trade-marks-act-and-cpc\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Territorial_Jurisdiction_Under_Trade_Marks_Act_And_CPC\"><\/span>Territorial Jurisdiction Under Trade Marks Act And CPC<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The Court noted that while Section 134 of the Trade Marks Act gives an additional forum where the plaintiff resides or works, ordinary rules under Section 20 of the CPC also apply.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Here, the plaintiff had specifically pleaded that:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Defendant No. 1 has its registered office in Delhi.<\/li>\n\n\n\n<li>The defendant maintains a website with a \u201cContact Us\u201d page showing a Delhi address and contact details.<\/li>\n\n\n\n<li>The defendant lists products on third-party websites, namely IndiaMart and Justdial, accessible in Delhi.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">These averments, taken as true, were held sufficient to establish that part of the cause of action arose in Delhi.<\/p>\n\n\n\n<h3 id=\"h-important-judgments-discussed-by-the-court\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Important_Judgments_Discussed_By_The_Court\"><\/span>Important Judgments Discussed By The Court<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The court discussed several important judgements. She relied on:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>World Wrestling Entertainment Inc. v. Reshma Collection, 2014 SCC OnLine Del 2031<\/strong><\/li>\n\n\n\n<li><strong>Kohinoor Seed Fields India Pvt Ltd v. Veda Seed Sciences Pvt Ltd, 2025 SCC OnLine Del 8727<\/strong><\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">These cases were referred to explain the difference between passive and interactive websites.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court also referred to the following:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Sun Pharmaceutical Industries Ltd v. Artura Pharmaceuticals, 2025 SCC OnLine Del 8642<\/strong><\/li>\n\n\n\n<li><strong>Cadila Healthcare Ltd v. Uniza Healthcare LLP, 2021 SCC OnLine Del 3330<\/strong><\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">In these matters, similar \u201cContact Us\u201d pages and online listings were considered enough for jurisdiction at the prima facie stage.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The judge clarified that questions like<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Whether actual sales occurred, or<\/li>\n\n\n\n<li>Whether the website is truly passive<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">require full evidence at trial and cannot be decided while considering the return of the plaint.<\/p>\n\n\n\n<h3 id=\"h-court-rejection-of-drug-licence-objection\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Court_Rejection_Of_Drug_Licence_Objection\"><\/span>Court Rejection Of Drug Licence Objection<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The court rejected the argument that absence of a drug licence in Delhi automatically removes jurisdiction, noting this is a defence to be examined later.<\/p>\n\n\n\n<h2 id=\"h-final-decision-of-the-court\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Final_Decision_Of_The_Court\"><\/span>Final Decision Of The Court<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Delhi High Court dismissed the application under Order VII Rule 10 CPC.
