The case highlights the growing importance of documentary evidence, expert financial analysis, and the UAE judiciary&#8217;s commitment to ensuring fairness in cross-border commercial transactions.<\/p>\n\n\n\n<h2 id=\"h-facts-of-the-case\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Facts_of_the_Case\"><\/span>Facts of the Case<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Our client, an overseas importer specializing in automotive spare parts, entered into a commercial trading arrangement with a UAE-based exporter. Under the business arrangement, the importer regularly transferred advance payments to the exporter, who was expected to supply the agreed goods and issue the corresponding commercial invoices.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Over a period exceeding two years, the parties conducted numerous transactions, establishing a continuous and well-documented commercial relationship. Although there was no formal written agreement governing the relationship, the pattern of payments, invoices, shipping records, and correspondence clearly reflected an ongoing business arrangement between the parties.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As is common in many international trading relationships, the parties relied on mutual trust and established commercial practices rather than executing a comprehensive written contract.<\/p>\n\n\n\n<h2 id=\"h-discovery-of-financial-discrepancies\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Discovery_of_Financial_Discrepancies\"><\/span>Discovery of Financial Discrepancies<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">During an internal financial review, our client identified significant discrepancies between:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The total value of advance payments transferred to the exporter;<\/li>\n\n\n\n<li>The value of goods actually received;<\/li>\n\n\n\n<li>Commercial invoices issued by the exporter; and<\/li>\n\n\n\n<li>Accounting statements covering the entire trading relationship.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Following an extensive investigation, the committee concluded that a substantial outstanding amount remained payable to our client and that the exporter had failed to deliver goods corresponding to a significant portion of the payments received.<\/p>\n\n\n\n<h2 id=\"h-judgment-of-the-court\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Judgment_of_the_Court\"><\/span>Judgment of the Court<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Court of First Instance adopted the findings of the expert committee in full.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court ruled that the exporter was liable to repay the confirmed outstanding balance and awarded damages in accordance with the provisions of the UAE Civil Transactions Law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court further recognized that the exporter\u2019s conduct had caused actual financial harm to the importer, including losses naturally arising from the disruption of commercial activities and delayed access to funds.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Accordingly, the court ordered the defendant to do the following:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Repay the outstanding amount;<\/li>\n\n\n\n<li>Compensate the claimant for proven damages;<\/li>\n\n\n\n<li>Pay court fees and expenses;
