State of Bihar<\/strong> held that police must not mechanically arrest in 498A-type cases and must satisfy the statutory conditions for arrest.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Under Section 35 BNSS, where arrest is not required, police must issue a notice of appearance.
