The court emphasised that the right to live with dignity is central to matrimonial life and that maintenance provisions exist to prevent destitution rather than to punish a spouse.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The ruling was delivered by Justice Urmila Joshi-Phalke in <strong>M J vs L M J<\/strong>, where the court dismissed a revision petition filed by the husband and upheld the Family Court&#8217;s order granting maintenance to the wife.<\/p>\n\n\n\n<h2 id=\"h-background-of-the-case\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Background_Of_The_Case\"><\/span>Background Of The Case<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The parties were married according to Hindu rites. According to the wife, disputes began immediately after marriage due to alleged dowry demands and persistent harassment by members of the matrimonial family.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">She alleged that she was subjected to both physical and mental cruelty and specifically referred to an incident on June 4, 2014, when she was allegedly assaulted with a waist belt. Following the incident, she approached the police and later sought assistance from the Women&#8217;s Cell.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The husband denied all allegations and argued that<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The wife had voluntarily left the matrimonial home.<\/li>\n\n\n\n<li>There was no sufficient cause for her to live separately.<\/li>\n\n\n\n<li>Her decision to file a divorce petition demonstrated her unwillingness to cohabit.<\/li>\n\n\n\n<li>Therefore, she should not be entitled to maintenance under Section 125 of the Code of Criminal Procedure.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The Family Court, however, granted maintenance to the wife, and the husband challenged that order before the High Court.<\/p>\n\n\n\n<h2 husband failed to effectively rebut the allegations of harassment and assault.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An important factor that weighed against him was that despite receiving notice of the divorce proceedings initiated by the wife, he chose not to contest those proceedings.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court reiterated that maintenance proceedings are distinct from matrimonial fault-finding exercises and that the purpose of Section 125 CrPC is primarily social welfare.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow class=\"wp-block-paragraph\">The most discussed aspect of the judgement is the court&#8217;s observation that a wife may have sufficient reason to live separately even when the husband is not personally responsible for every act of ill-treatment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">According to the Court:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Ill-treatment by members of the matrimonial family can be relevant.<\/li>\n\n\n\n<li>A hostile domestic atmosphere may justify separate residence.<\/li>\n\n\n\n<li>A woman cannot reasonably be expected to sacrifice her dignity merely to preserve cohabitation.<\/li>\n\n\n\n<li>Courts must examine whether she can realistically live with self-respect in the matrimonial home.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The judgement recognises that matrimonial life is influenced not only by the conduct of spouses but also by the overall environment in which the wife is expected to avoid maintenance liability.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">A superficial or tactical offer may not defeat a wife&#8217;s claim for maintenance.<\/p>\n\n\n\n<h2 that following the implementation of India&#8217;s new criminal laws in 2024, the maintenance provisions have largely been carried forward under the <strong>Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS)<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The principles governing maintenance remain substantially unchanged:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Financial support to dependent wives continues to be protected.<\/li>\n\n\n\n<li>Courts retain the power to grant maintenance where neglect is established.<\/li>\n\n\n\n<li>The welfare-orientated nature of maintenance law remains intact.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, this judgement is likely to remain relevant under both the former CrPC framework and the present BNSS
