This is not true.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Even after a husband succeeds in obtaining an RCR decree, he cannot:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Physically force his wife to return home.<\/li>\n\n\n\n<li>Seek police assistance to bring her back.<\/li>\n\n\n\n<li>Use threats, coercion, or social pressure.<\/li>\n\n\n\n<li>Demand marital relations against her wishes.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The decree is essentially a civil court order expressing that the spouse should resume matrimonial life. Sudarshan Kumar Chadha (1984)<\/em>, where the Court upheld the validity of Section 9. Rina Devi v. Reena v. Dinesh Kumar Mahto (2025)<\/em>, the Supreme Court clarified that merely obtaining a decree for restitution of conjugal rights does not automatically deprive a wife of maintenance under Section 125 CrPC.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court emphasised that the circumstances behind the wife&#8217;s refusal to return must be examined.<\/p>\n\n\n\n<h3 id=\"h-factors-considered-by-courts-in-maintenance-cases\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Factors_Considered_by_Courts_in_Maintenance_Cases\"><\/span>Factors Considered by Courts in Maintenance Cases<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Questions that courts may consider include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Was the wife subjected to cruelty?<\/li>\n\n\n\n<li>Was the matrimonial environment safe?<\/li>\n\n\n\n<li>Did the husband genuinely attempt reconciliation?<\/li>\n\n\n\n<li>Was there neglect or harassment?<\/li>\n\n\n\n<li>Was the wife&#8217;s decision to live separately justified?<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">If the wife has legitimate reasons for staying away, maintenance may continue despite the existence of an RCR decree.<\/p>\n\n\n\n<h2 id=\"h-karnataka-high-court-on-mere-notices-and-requests\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Karnataka_High_Court_on_Mere_Notices_and_Requests\"><\/span>Karnataka High Court on Mere Notices and Requests<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Courts have also made it clear that simply asking a wife to return is not the same as enforcing an RCR decree.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In <em>Chethan Kumar v. Sushma<\/em>, the husband argued that he had repeatedly requested his wife to return and had even issued legal notices. He contended that he should therefore be relieved from maintenance obligations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Karnataka High Court disagreed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court observed that sending notices or making informal requests does not amount to proper execution of a restitution decree. Legal enforcement requires following the procedures prescribed under law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A legal notice is not execution.<\/li>\n\n\n\n<li>A WhatsApp message is not execution.<\/li>\n\n\n\n<li>Family intervention is not execution.<\/li>\n\n\n\n<li>Telephone requests are not execution.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Proper legal remedies must be pursued if a party wishes to rely on an RCR decree.<\/p>\n\n\n\n<h2 id=\"h-conclusion\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Indian law does not permit a husband to legally force his wife to return to the matrimonial home or cohabit against her will.
